HomeMy WebLinkAboutRes No 1241PLANNING COMMISSION RESOLUTION NO. 1241 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND A 29 LOT TENTATIVE TRACT MAP LOCATED WEST OF THE PALM VALLEY STORM CHANNEL NORTH OF THE PALM DESERT COMMUNITY CENTER. CASE NO. TT 19503 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 21st day of July, 1987, hold a duly noticed public hearing to consider a request by GEORGE FOX for approval of a 29 lot tentative tract map associated hillside development plan and Negative Declaration of Environmental Impact on 66.2 acres with the hillside planned development drainageway overlay zone located west of the Palm Valley Storm Channel north of the Palm Desert Community Center; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of community development has determined that the project will not have a significant adverse impact on the environment and a negative declaration has been prepared; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said planning commission did find the following facts and reasons to exist to approve the tentative tract map. 1. As conditioned, the proposed map, its design, improvements, type of development and density are consistent with the State Subdivision Map Act, Palm Desert Subdivision and Zoning Ordinances, General Plan and the West Hills Specific Plan. 2. The design of the subdivision will not result in substantial environmental damage, injure fish or wildlife or result in public health problems. Only 5% of the hillside area will be subject to development. 3. The design will not conflict with public easements. 4. The design will allow unrestricted solar access to all lots. WHEREAS, in the review of this tentative tract map the Planning Commission has considered the effect of the contemplated action on the housing needs of the region for purposes of balancing these needs against the public service needs of the residents of the City of Palm Desert and its environs, with available fiscal and environmental resources. PLANNING COMMISSION RESOLUTION NO. 1241 NOW, THEREFORE, BE IF RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That a Negative Declaration of Environmental Impact, Exhibit A, is hereby approved. 3. That it does hereby approve the above described Tentative Map No. 19503 for the reasons set forth in this resolution and subject to the attached conditions. DIAZ, Secre /hs 2 RI HARD ERWOOD, Chairman PLANNING COMMISSION RESOLUTION N0. 1241 CONDITIONS Of APPROVAL CASE N0. TT 19503 Department of Community Development: 1. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the city which include, but are not limited to, architectural review and building permits. 2. The development of the property shall conform with all approved exhibits on file with the department of community development, to all municipal, state, and federal statutes now in force or which hereafter may be in force. 3. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Health Department Palm Desert Water and Services District City Fire Marshal Coachella Valley Water District 4. All on -site utilities shall be placed underground. 5. Applicant shall employ all available technologies to reconstruct and renaturalize all disturbed areas. 6. Applicant shall install suitable facilities adjacent to the Palm Valley Storm Channel right-of-way to prohibit access to this right-of-way to the satisfaction of the Coachella Valley Water District. Department of Public Works: 1. Drainage and signalization fund fees, as required by City ordinance, shall be paid prior to (recordation of the final map). 2. Drainage facilities shall be provided, per Ordinance No. 218 and the Master Drainage Plan, to the specifications of the Director of Public Works. 3. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the Department of Public Works. 3 PLANNING COMMISSION RESOLUTION N0. 1241 4. Improvement plans for water and sewer systems shall be approved by the respective service districts with "as -built" plans submitted to the Department of Public Works prior to the project final. 5. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the Director of Public Works for checking and approval before construction of any improvements is commenced. The engineer shall submit "as -built" plans prior to the acceptance of the improvements by the City. 6. Complete grading plans and specifications shall be submitted, as required by ordinance, to the Director of Public Works for checking and approval prior to issuance of any permits. 7. Full improvement of interior streets based on private street standards as established in accordance with Chapter 26, Section 26.40.040, C.P.D. 8. Complete tract maps shall be submitted as required by ordinance to the Director of Public Works for checking and approval and be recorded before issuance of any permits. 9. Phase I street and storm drain system shall be completed prior to construction of Phase II improvements. City Fire Marshal: 1. Install a water system capable of delivering 1500 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street intersection (a) but not greater than 500 feet apart in any direction (b) all buildings shall be within 250 feet from a fire hydrant. A. exterior surface of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. B. curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. 4 PLANNING COMMISSION RESOLUTION NO. 1241 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in TT 19503 is in accordance with the requirements prescribed by the fire marshal". Upon approval, the original plan will be returned to the developer. 5. Prior to delivery of combustible materials to the building site. the required water system shall be installed, operating and delivering the required flow. 6. 40' radius curb return shall be provided as part of each intersection as approved by the Fire Marshal. 7. Each building site shall contain an approved hammerhead turn -around. 8. Slopes of streets shall not exceed 18%, except for access to roads to lots 13 and 14 which shall be permitted 19.2% slope. 9. Flood control systems shall be separate from and shall protect vehicle travelways. 10. All buildings are to be protected with residential fire sprinklers. 11. The Director of the Department of Community Development, City of Palm Desert, California, has found that the described project will not have a significant effect on the environment. A copy of the initial study has been attached to document the reasons in support of this finding.
