A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA. APPROVING A
REQUEST BY PAPA DAN'S PIZZA 8 PASTA FOR A
CONDITIONAL USE PERMIT TO ALLOW AN 1100 SQUARE
FOOT ADDITION TO AN EXISTING RESTAURANT WHICH
WILL BE LICENSED BY THE ALCOHOL BEVERAGE CONTROL
DEPARTMENT FOR THIS ON PREMISE SALE AND
CONSUMPTION OF BEER AND WINE AT 73-131 COUNTRY
CLUB DRIVE.

WHEREAS. the Planning Commission of the City of Palm Desert. California.
did on the 4th day of August 1987, hold a duly noticed public hearing to
consider the request for approval of a conditional use permit to allow the
above noted restaurant's use; and
WHEREAS. said application has complied with the requirements of the "City
of Palm Desert Procedure for Implementation of the California Environmental
Quality Act. Resolution No. 80-89," in that the director of community
development has determined that the project is a class 1 categorical exemption;
and
WHEREAS. at said public hearing. upon hearing and considering all
testimony and arguments, of all interested persons desiring to be heard. said
commission did find the following facts and reasons to exist to justify the
granting of said conditional use permit:
1. The proposed location of the conditional use is in accord with the
objectives of the Zoning ordinance and the purpose of the district
in which the site is located.
2. The proposed location of the conditional use and the conditions
under which it will be operated and maintained will not be
detrimental to the public health, safety or general welfare. or be
materially incurious to properties or improvements in the vicinity.
3. The proposed conditional use will comply with each of the applicable
provisions of this title. except for approved variances or
adjustments.
4. The proposed conditional use complies with the goals, objectives and
policies of the citv's adopted general plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.
L. That approval of Conditional Use Permit 87-9 is hereby granted for
reasons subject to the attached conditions.

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this l8th day of August, 1987, by the following
vote, to wit:

CONDITIONS OF APPROVAL
CASE N0. CUP 87-9
Department of Community Development
1. Prior to issuance of business license for operation of this expanded
facility the applicant shall first obtain permits and/or clearances from
the following agencies:
Riverside County Department of Health
City Fire Marshal
City Building Department
2. That the hours of operation for this restaurant shall be 11:00 a.m. to
10:00 p.m. Sunday thru Thursday and 11:00 a.m. to 11:00 p.m. Friday and
Saturday.
3. That there shall be no live music or entertainment without amendment to
this permit.
4. That this restaurant shall not establish or operate a "happy -hour"
without amendment to this permit.
Approval of this permit is for the expanded restaurant to he able,
subject to issuance of the necessary license from the State Department of
Alcohol Beverage Control, to sell beer and wine only; any expansion of
the beer and wine license will require an amendment of this permit.
6. Location and amount of outdoor seating shall he periodically reviewed by
staff.
7. Alcoholic beverages shall only be served inside the restaurant.
