HomeMy WebLinkAboutRes No 1257PLANNING COMMISSION RESOLUTION N0. 1257 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING A GENERAL PLAN AMENDMENT AND ZONE CHANGE AND PRECISE PLAN FOR A 40,850 SQUARE FOOT MEDICAL OFFICE PLAZA LOCATED AT THE NORTHEAST CORNER OF HOVLEY LANE AND MONTEREY AVENUE. CASE N0. GPA 87-4 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 15th day of September, 1987 hold a duly noticed hearing to consider the request of DAVID and MARY STOLTZMAN for above mentioned project; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89", in that the director of community development has determined that the project will not have a significant environmental impact and a negative declaration has been prepared; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify the granting of said denial: 1. The project would interfere with the orderly development in the vicinity by locating in a largely undeveloped area, surrounded by existing and planned residential uses, thereby proving incompatible. 2. There is sufficient land in the vicinity, adjacent to commercial uses that would be more suitable for medical office uses that would meet the basic Intent for office professional uses. 3. The proposal is inconsistent with the City's General Plan without an office professional designation. 4. The project is inconsistent with the objectives of the zoning ordinance by creating a conflict between land uses due to variations in intensities of use in respect to traffic generation. 5. Property owners in the vicinity have indicated that the change of zone would negatively impact their life styles and property values through the generation of increased traffic in the area. 6. Property owners in the vicinity indicated that they had depended on the existing zoning and general plan when acquiring their residential properties. 7. There has not been demonstrated a compelling reason to revise the general plan zoning on the site to permit this use. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: PLANNING COMMISSION RESOLUTION NO. 1257 1. That the above recitations are true and correct and constitute the 1110 findings of the commission in this case. 2. That GPA 87-4 is hereby denied. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 6th day of October, 1987, by the following vote, to wit: AYES: DOWNS, LADLOW, RICHARDS & ERWOOD NOES: NONE ABSENT: WHITLOCK ABSTAIN: NONE / ATTEST: RAMON A.
