A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, APPROVING A
PRECISE PLAN OF DESIGN AND NEGATIVE DECLARATION
OF ENVIRONMENTAL IMPACT TO ALLOW A 3.58 ACRE
EXPANSION TO A PARKING AND STORAGE AREA AND A
SECOND STORY ADDITION TO AN EXISTING STRUCTURE
LOCATED ON THE SOUTH SIDE OF LENNON PLACE BETWEEN
ECLECTIC AND CORPORATE WAY.
CASE NO: PP 16-83 AMENDMENT #2
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 17th day of November, 1987, hold a duly noticed public hearing to
consider the request of PALM DESERT DISPOSAL for approval of a negative
declaration and precise plan of design for the above mentioned project; and
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedure for Implementation of the California Environmental
Quality Act, Resolution No. 80-89", in that the director of community develop-
ment has determined that the project will not have a significant adverse impact
on the environment and a negative declaration has been prepared, and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said planning commission did find the following facts and reasons to
exit to justify granting approval of said precise plan:
1. The precise plan is consistent with the intent and purpose of the
service industrial zone and the Palm Desert General Plan.
2. The use is specifically permitted by section 25.34.020 of the Palm
Desert Municipal Code.
3. The project will not endanger the public peace, health, safety or
general welfare.
4. The use has previously been determined to be acceptable at this
location.
5. Since the time of the original plan approval office/industrial
projects have been approved in the area. The project may be
detrimental to some extent on property values but not substantially
while the use will be low in terms of marking which could benefit the
area if parking problems occur.
6. The facility is under county health permits which protects the
health concerns etc.

NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. That approval of Precise Plan 16-83 Amendment #2 is hereby granted
for reasons subject to the attached conditions.
3. That a negative declaration of environmental impact is hereby
approved and said negative declaration and initial study, therefore,
are attached hereto as exhibit "A" and made a part hereof.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this l7th day of November, 1987, by the following
vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. PP 16-83 Amendment #2
Department of Community Development:
1. The development of the property shall conform substantially with exhibits
on file with the department of community development, as modified by the
following conditions.
2. Construction of a portion of said project shall commence within one year
from the date of final approval unless an extension of time is granted;
otherwise said approval shall become null, void and of no effect
whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to
all municipal ordinances and state and federal statutes now in force, or
which hereafter may be in force.
4. Prior to issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain permits
and/or clearance from the following agencies:
Riverside County Department of Health
Palm Desert Architectural Commission
City Fire Marshal
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be
presented to the department of building and safety at the time of issuance
of a building permit for the use contemplated herewith.
5. Applicant agrees to join an assessment district and contribute reasonable
assessment fees for future improvements to Cook Street.
6. Applicant to pay applicable fees for Art in Public Places program.
7. Applicant to pay applicable lizard fees.
S. No residential trash trucks to use Lennon Place.
9. Landscaping to be upgraded throughout the site and include interior
landscaping where adjacent to private property.
10. Applicant shall pay drainage fees in effect as the time of application,
if said fees have not already been paid to the city as part of a previous
approvals on this site.

II. Applicant shall pay appropriate City of Palm Desert signalization fees in
effect at the time of application.
Department of Public Works:
1. Complete improvement plans and specifications shall be submitted, as
required by ordinance, to the city engineer for checking and approval
before construction of any improvements is commenced. The engineer shall
submit "as -built" plans prior to the acceptance of the improvements by
the city.
2. All private driveways and parking lots shall be inspected by the
engineering department and a standard inspection fee shall be paid prior
to grading permit issuance.
3. Landscaping maintenance on Lennon Place and Corporate Way shall be
provided by the property owner.
4. Complete grading plans and specifications shall be submitted, as required
by ordinance, to the city engineer for checking and approval prior to
issuance of any permits.
5. Offsite improvement plans to be approved by public works department and a
surety posted to guarantee the required offsite improvements prior to
grading permit issuance.
6. Size, number and location of driveways to public works specifications
with only one driveway approach from Lennon Place to be allowed to service
this property.
7. Original conditions apply as per Planning Commission Resolution for
Precise Plan 16-83.
8. Any and all offsite improvements shall be preceded by the approval of
plans and the issuance of valid encroachment permits by the department of
public works.
City Fire Marshal:
1. Additional fire protection requirements may be necessary when the
applicant submits specific plans for consideration and approval.
2. All buildings over 5000 square feet require an approved fire sprinkler
system.
