HomeMy WebLinkAboutRes No 1267PLANNING COMMISSION RESOLUTION NO. 1267 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND GENERAL PLAN FOR 160 +/- ACRES GENERALLY IN THE SOUTHEAST QUARTER OF SECTION 10. CASE N0: GPA 87-5 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 20th day of October, 1987 hold a duly noticed public hearing which was continued to December 15, 1987 to consider approval of a negative declaration of environmental impact and general plan amendment affecting 160 +/- acres generally in the southeast quarter of section 10 (ie: the area south of the Lakes Country Club, north of 42nd Avenue east of the present city boundary). The City of Palm Desert General Plan will be adopted and thereby be expanded to cover the subject area. Said general plan will be effective upon annexation of the area to the City of Palm Desert. The area will be designated residential low density three to five dwelling units per acre except for the Good Samaritan Village 20 acre site which will be designated residential high density seven to eighteen dwelling units per acre. In addition, the area will be served by a local street system connecting to Hovley Lane in the southwest and Eldorado Drive in the northeast. WHEREAS, in addition to expanding the city's general plan to cover the subject area, the existing circulation element will be amended to dead end Hovley Lane west of the present city boundary and establish a collector street running north which will connect to the collector street system in the subject area. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have an adverse impact has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested person desiring to be heard, said planning commission did find the following facts and reasons to exist to justify a recommendation of approval. 1. The subject area (160 acres in the southeast quarter of section 10) is within the City of Palm Desert Sphere of Influence as established by LAFCO. 2. The City of Palm Desert is desirous of annexing said area to the city. 3. Prior to filing the necessary application with LAFCO to annex the area to the city the city must prezone the area. Prior to prezoning the subject area the city's general plan must be in place in order that the city can make the finding that the proposed zoning is consistent with the adopted general plan. 5. The proposed residential land use and densities are compatible with those allowed under the County of Riverside plan and in the adjacent City of Palm Desert plan. 6. The proposed street system and amendment to the existing city street system will provide adequate vehicle access to serve the 160 acre area as well reducing the potential for future traffic impacts which could result from the extension of Hovley Lane through to Washington Street. 7. The proposed general plan protects the public health, safety and general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That a negative declaration of environmental impact, Exhibit "A", is hereby recommended for approval. 3. That Exhibit "B" attached hereto delineating the area and the proposed land use designations as well as circulation system for the area is hereby recommended for approval. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 15th day of December, 1987 by the following vote, to wit: AYES: DOWNS, LADLOW, RICHARDS, WHITLOCK, AND ERWOOD NOES: NONE ABSENT: NONE ABSTAIN: NONE ATTEST: RAMON A. CASE N0: GPA 87-5 APPLICANT/PROJECT SPONSOR: CITY OF PALM DESERT PROJECT DESCRIPTION/LOCATION: A negative declaration of environmental impact and general plan amendment affecting 160 acres generally in the southeast quarter of section 10 (ie: the area south of the Lakes Country Club, north of 42nd Avenue east of the present city boundary). The City of Palm Desert General Plan will be adopted and thereby be expanded to cover the subject area. Said general plan will be effective upon annexation of the area to the City of Palm Desert. The Director of the Department of Community Development, City of Palm Desert, California, has found that the described project will not have a significant effect on the environment. A copy of the initial study has been attached to document the reasons in support of this finding.
