HomeMy WebLinkAboutRes No 1278PLANNING 0344ffSSION RESOLUTION NO. 1278 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A 15 LOT RESIDENTIAL SUBDIVISION ON THE WEST SIDE OF EDGEHILL SOUTH OF PITAHAYA. CASE NO: TT 23148 WHEREAS, the Planning Carmission of the City of Palm Desert, California, did on the 2nd day of February, 1988, hold a duly noticed public hearing to consider the request of WM. MURRAY & ASSOCIATES for the above mentioned project. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will have no possible effect on the environment. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify the granting of said tentative tract map. 1. That the proposed map is consistent with applicable general and specific plans. 2. That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. 3. That the site is physically suitable for the type of development. 4. That the site is physically suitable for the proposed density of development. 5. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. 6. That the design of the subdivision or the type of improvements is not likely to cause serious public health problems. 7. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. 8. That the design of the subdivision will not restrict solar access. WHEREAS, in the review of this tentative tract map the Planning Commission has considered the effect of the contemplated action on the housing needs of the region for purposes of balancing these needs against the public service needs of the residents of the City of Palm Desert and its environs, with available fiscal and environmental resources. RESOLUPION NO. 1278 NOW, THEREFORE, BE IF RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That it toes hereby approve the above described Tentative Map No. 23148 for the reasons set forth in this resolution and subject to the attached conditions. TT 23148 Department of Community Development: 1. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. Constriction of the total development may be done in phases; however, each individual phase shall meet or exceed all municipal code requirements to the degree that the city could consider each phase as a single project. 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in aridition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. The applicant shall have twenty-four (24) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time as permitted by code is granted by planning camussion. 6. All on -site utilities, including cable TV, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the director of community development. 7. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the city and free of all liens and encumbrances. 8. Setbacks and lot coverage restrictions shall be minimum R-1 standards. 3 RESOLUTION I. 1278 9. Maximum building heights shall be 15 feet or 18 feet with architectural commission approval. 10. Block wall is required along west property line except for the drainage easement area a wood fence is permissable. 11. All property lines separating lots shall be at top of slope. 12. School fees and art fees as required by ordinance paid prior to building permit issuance. 13. Lot 10 to have deed restriction restricting permanent structures or deep rooted trees on easement. Department of Public Works: 1. Drainage fees, in accordance with Section 26.49 of the Palm Desert Municipal Code and Palm Desert Ordinance No. 507, shall be paid prior to recordation of final map. 2. Storm drain construction shall be contingent upon a drainage study prepared by a civil engineer that is reviewed and approved by the department of public works. 3. Signalization fees, in accordance with City of Palm Desert Resolution No's. 79-17 and 79-55, shall be paid prior to recordation of final map. 4. Full public improvements, as required by Sections 26.44 and 26.40 of the Palm Desert Municipal Code, shall be installed in accordance with applicable city standards. 5. As required under Palm Desert Municipal Code Section 26.28, and in accordance with Sections 26.40 and 26.44, complete improvement plans and specifications shall be submitted to the director of public works for checking and approval before construction of any improvements is commenced. Off -site improvement plans to be approved by public works department and a surety posted to guarantee the installation of required off -site improvements prior to recordation of the final map. Such off -site improvements shall include, but not be limited to, curb and gutter, asphalt paving and concrete sidewalk in an appropriate size and configuration. "As -built" plans shall be submitted to, and approved by, the director of public works prior to the acceptance of the improvements by the city. 6. Improvement plans for water and sewer systems shall be approved by the respective service districts with "as -built" plans submitted to the department of public works prior to the project final. 4 RESOLITrICN ND. 1278 7. Landscape maintenance on Edgehill Drive shall be provided by the property owner. 8. Complete tract map shall be submitted, as required by ordinance, to the director of public works for checking and approval and be recorded before issuance of any permits. 9. Any and all off -site improvements shall be preceded by the approval of plans and the issuance of valid encroachment permit(s) by the department of public works. 10. A completed preliminary soils investigation, conducted by a registered soils engineer, shall be submitted to and approved by the department of public works prior to issuance of the grading permit. 11. Pad elevations, as shown on the tentative map are subject to review and modification in accordance with Section 25 of the Palm Desert Municipal Code. City Fire Marshal: The following fire protection requirements are in accordance with the Uniform Fire Code and Life Safety Code standards. 1. Install a water system capable of delivering 1500 GPM fire flow from any fire hydrant for a 2 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. c. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. 5 RESOLUrI X1 NO. 1278 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in TT 23148 is in acoordance with the requirements prescribed by the fire marshal". /dig 6
