HomeMy WebLinkAboutRes No 1294PLANNING COMMISSION RESOLUTION NO. 1294 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO COUNCIL APPROVAL OF A MASiTR PLAN OF DEVELOPMENT FOR THE CIVIC (ENTER SITE BORDERED BY SAN PABLO AVENUE AND THE SAN PASCUAL CHANNEL ON THE WEST AND EAST; MAGNESIA FALLS DRIVE AND FRED WARING DRIVE ON THE NORTH AND SOUTH; AND A CHANGE OF ZONE FROM P.R.-7 TO PUBLIC INSTITUTION. CASE NO: QJP 87-14, C/Z 88-5 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 21st day of June, 1988, hold duly noticed public hearings to consider the request of CITY OF PALM DESERT for the above mentioned project. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89", in that the director of community develop- ment has determined that the proposed project will not have a significant environmental impact and that a negative declaration should be certified. WHEREAS, at said public hearing, upon hearing and considering all testimony and arganents, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exit to justify their actions: 1. The proposed location of the conditional use is in accord with the objectives of the zoning ordinance and the purpose of the district in which the site is located. 2. The proposed location of the conditional use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety or general welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed conditional use will comply with each of the applicable provisions of this title, except for approved variances or adjustments. 4. The proposed conditional use complies with the goals, objectives, and policies of the city's adopted general plan. 5. The change of zone is consistent with the city's adopted general plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case; PLANNING CCMMISSION RESOLiTPION NO. 1294 2. That approval of Conditional use permit is hereby granted for reasons subject to the attached conditions. DIAZ, /fr eb� cret .47 RIC ARD ERWOOD, Chairman FLAWING OISSIO[T RESOLUTION N0. 1294 CM CONDITIMS OF APPROVAL CASE NO: QJP 87-14, C/Z 88-5 Department of Community Development. 1. Landscape and irrigation plans shall be reviewed by Coachella Valley Water District and a conscientious effort toward water conservation implemented. Working drawings shall specifically identify water conservation measures and outline their impact. 2. All landscape plans shall be submitted to the County of Riverside Agricultural Department for approval to assure that proposed materials will not impact or threaten the valley's agricultural industry. 3. Construction shall be limited to daytime hours and no Sunday construction. 4. Parking demand shall be monitored for at least six months after any facility is developed and put in use. If it is determined that parking is insufficient or a problem id developing, corrective measures shall be identified and implemented within six months. If it is determined that a corrective measure cannot be implemented within the prescribed period, council shall establish a specific implementation schedule. 5. Prior to the installation of any lighting a complete engineered lighting plan shall be reviewed and approved. Where possible temporary lights shall be installed to examine their impact prior to installation. In no event shall athletic fields be lighted after 10:30 p.m. 6. On all portions of this project, these mitigation measures shall be adhered to and the city council shall receive a report of adherence to these measures from the department of community development. 7. The development of the property shall conform substantially with all approved exhibits on file with the department of community development/planning, as modified by the following conditions 8. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Palm Desert Architectural Commission Palm Desert Water and Services District City Fire Marshal Coachella Valley Water District Public Works Department 3 PLANNING C M4ISSION RESOLUTION ND. 1294 Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 9. The grading plan of the site shall be performed in such a manner as to mitigate potential noise and lighting impacts such as lowering of ballfields and hardcourts wherever feasible. Department of Public Works: 1. Any and all site developments shall conform to all applicable Palm Desert codes, resolutions and ordinances. City Fire Marshal: 1. With respect to the conditions of approval regarding the above referenced WP87-14, the Fire Department recommends the following fire protection measures be provided in accordance with Riverside County Ordinance, and/or recognized Fire Protection Standards: The Fire Department is required to set a minimum fire flow for the remodel or construction of all ccvnercial buildings per Uniform Code Sec. 10.301C. .ri 2. Provide, or show there exists a water system capable of providing a potential fire flaw of 3000 gpm and the actual fire flow available from any one hydrant connected to any given water main shall be 1500 gpm for 2 hours duration at 20 psi residual operating pressure. 3. A fire flow of 1500 gpm for a 2 hour duration at 20 psi residual operating pressure must be available before any combustible material is placed on the job site. 4. A combination of on -site and off -site Super fire hydrants, (6" x 4" x 2-1/2" x 2-1/2"), will be required, located not less than 25' or more than 150' from any portion of the building(s) as measured along approved vehicular travelways. The required fire flow shall be available from any adjacent hydrant(s) in the system. 5. Prior to the application for a building permit, the developer shall furnish the original and two copies of the water system plan to the County Fire Department for review. No building permit shall be issued until the water system plan has been approved by the County Fire Chief. Upon approval, the original will be returned. One copy will be sent to the responsible inspecting authority. 4 PLANNMG 0:MIISSION RESouirICN No. 1294 Plans shall conform to fire hydrant types, location and spacing, and the system shall meet the fire flow requirements. Plans shall be signed by a Registered Civil Engineer and may be signed by the local water many with the following certification: "I certify that the design of the water system is in accordance with the requirements prescribed by the Riverside County Fire Department." 6. Install a complete fire sprinkler system per NFPA 13. The post indicator valve and fire department connection shall be located to the front, not less than 25' from the building and within 50' of an approved hydrant. 7. Install a fire alarm (waterflow) as required by the Uniform Building Code, 3803, for sprinkler system. 8. Install tamper alarm on supply valve for sprinkler systems. Must also ring water flow alarm. 9. Certain designated areas will be required to be maintained as fire lanes. 10. Install portable fire extinguishers per NFPA, Pamphlet #10, but not less than 2A1OBC in rating. 11. A11 buildings shall be accessible by an all-weather roadway extending to within 150' of all portions of the exterior walls of the first story. The roadway shall be not less than 24' of unobstructed width and 13' 6" of vertical clearance. Where parallel parking is allowed, the roadway shall be 36' wide with parking on both sides, 32' wide with parking on one side. Dead-end roads in excess of 150' shall be provided with a minimum 45' radius turn -around (55' in industrial developments). 12. Contact the Fire Department for a final inspection prior to occupancy. 13. All questions regarding the meaning of these conditions should be referred to the Fire Department Fire Protection/Inspection Staff. /fr 5
