HomeMy WebLinkAboutRes No 1301PLANNING COMMISSION RESOLUTION NO. 1301 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND A CERTIFICATE OF NEGATIVE ENVIRONMENTAL IMPACT TO ALLOW THE OPERATION OF A CHURCH FACILITY ON 2.47 ACRES +/- IN THE PALM DESERT COMMUNITY CENTER. CASE NO. CUP 88-3 WHEREAS, the City of Palm Desert, California, has initiated an application to permit Desert Cities Baptist Church to use the Palm Desert Community Center, upon abandonment, as a church; WHEREAS, City of Palm Desert, California, did hold a duly noticed public hearing on July 19th, 1988, to accept all public testimony and review all pertinent reports on such application; WHEREAS, after reviewing all material and testimony the Palm Desert Planning Commission made the following findings: 1. The proposed location of the conditional use is consistent with the objectives of the zoning ordinance and the city's general plan in that: a. The proposed church is similar to the present use of the site -- a community center. b. The use will not intensify from the present land uses. c. A church is a use that is compatible with existing development and zoning. 2. The conditions under which the church will operate will not be detrimental to the health, safety, and general welfare in that: a. b. Should a nuisance occur, present city regulations and procedures permit re-evaluation of the permit. Those area residents presently receiving through the site will be granted easements. access 3. That a negative declaration of environmental impact should be certified for CUP 88-3 that, as demonstrated in the initial study and conditioned herein, the proposed use will not have a significant adverse impact on the environment. PLANNING COMOISSION RESOLUTION NO. 1301 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case; 2. That approval of Conditional Use Permit 88-3 is hereby granted for reasons subject to the attached conditions. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 19th day of July, 1988, by the following vote, to wit: AYES: ERWOOD, DOWNS, LADLOW, RICHARDS, WHITLOCK NOES: NONE ABSENT: NONE ABSTAIN: NONE /% t. Easements to existing residents through the property shall be granted as approved and required by the Palm Desert Public Works Department. 2. All applicable local, county, state and federal requirements relating to public gathering places shall be observed. 3
