HomeMy WebLinkAboutRes No 1307PLANNIM Ca"MIISSION RE.'SOLUI'IC O. 1307 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT ALLOWING A CHIROPRACTIC CLINIC TO OCCUPY 3,000 SQUARE FEET WITHIN AN OFFICE COMPLEX AT 72-880 FRED WARING DRIVE. CASE NO. CUP 88-6 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 6th day of September, 1988, hold a duly noticed public hearing to consider a request by DR. HOWARD SCANS for approval of a conditional use permit allowing a chiropractic clinic to occupy 3,000 square feet within an office complex at 72-880 Fred Waring Drive; and WHEREAS, said application has canplied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of crrmunity development has determined that the project is a class 3 categorical exemption; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify their actions: 1. The site and facility are suitable for use as a chiropractic clinic and are consistent with the objectives and specific provisions of the 0.P. zone. 2. The operation of the facility will not be detrimental to the public health, safety, welfare or be materially injurious to other properties in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That CUP 88-6 hereby approved. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 6th day of September, 1988, by the following vote, to wit: AYES: DOWNS, LADLOW, WHITLOCK, AND NOES: NONE ABSENT: ERWOOD ABSTAIN: NONE S, Vice Chairman ATTEST: RAMON A.
