A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT. CALIFORNIA, APPROVING A
NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND
A PRECISE PLAN OF DESIGN TO ALLOW CONSTRUCTION
OF A 6,500 SQUARE FOOT POOL SUPPLY WAREHOUSE IN
A SERVICE INDUSTRIAL ZONE LOCATED AT THE
NORTHWEST CORNER OF BEACON HILL AND
MEDITERRANEAN.
CASE N0: PP 85-34 (REFILE)
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 4th day of October, 1988 hold a duly noticed public hearing to
consider a request by GONZALO MENDOZA AND JIM FETRIDGE for above mentioned
pro sect.
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures for Implementation of the California Environmental
Quality Act, Resolution No. 80-89", in that the director of community
development has determined that the project will not have a significant impact
on the environment and a negative declaration is hereby certified.
WHEREAS, at said public hearing, upon hearing and considering all testi-
mony and arguments. if any, of all interested persons desiring to be heard,
said planning commission did find the following facts to exist to justify
the approval of said precise plan of design.
1. The design of the precise plan will not substantially depreciate
property values in the vicinity.
2. The precise plan will not unreasonably interfere with the use or
enjoyment of the property in the vicinity by the occupants thereof
for lawful purposes.
3. The precise plan will not endanger the public peace, health, safety
or general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert. California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. That approval of Precise Plan 85-34 (Refile) is hereby granted for
reasons subject to the attached conditions.
3. That a negative declaration of environmental impact is hereby
certified.

Planning Commission, held on this 4th day of October, 1986 by the following

CASE NO. PP 85-34 (REFILE)
Department of Community Development:
1. The development of the property shall conform substantially with exhibits
on file with the department of community development, as modified by the
following conditions.
2. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to
all municipal ordinances and state and federal statutes now in force, or
which hereafter may be in force.
3. Construction of a portion of said project shall commence within one year
from the date of final approval unless a time extension is granted, other-
wise said approval shall become null, void and of no effect whatsoever.
4. Prior to issuance of a building permit for construction of any use contem-
plated by this approval, the applicant shall first obtain permits and/or
clearance from the following agencies:
Riverside County Department of Health
Palm Desert Architectural Commission
City Fire Marshal
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be
presented to the department of building and safety at the time of issuance
of a building permit for the use contemplated herewith.
5. Applicant agrees to pay a future reasonable assessment for Cook Street
improvements including bridges at Interstate 10 and at the Whitewater
Channel.
6. Payment of lizard mitigation fees required prior to grading permit
issuance.
7. All future occupants of building shall comply with parking requirements
of the ordinance.

accordance with Sections 26.40 and 26.44, complete improvement plans and
specifications shall be submitted to the director of public works for
checking and approval before construction of any improvements is
commenced. Off -site improvement plans to be approved by public works
department and a surety posted to guarantee the installation of required
off -site improvements prior to issuance of grading permit. Such off -site
improvements shall include, but not limited to, concrete sidewalk in an
appropriate size and configuration. "As -built" plans shall be submitted
to. and approved by, the director of public works prior to the acceptance
of the improvements by the city.
4. All private driveways and parking lots shall be inspected by the
engineering department and a standard inspection fee shall be paid prior
to grading permit issuance.
5. Landscaping maintenance on Mediterranean and Beacon Hill shall be provided
by the property owner.
6. In accordance with Palm Desert Municipal Code Section 26.44, complete
grading plans and specifications shall be submitted to the director of
public works for checking and approval prior to issuance of any permits.
7. Size, number and location of driveways to public works specifications
with only two driveway approach(es) to be allowed to serve this property.
8. Pad elevations, as shown on the preliminary site plan are subject to
review and modification in accordance with Section 27 of the Palm Desert
Municipal Code.
9. Applicant shall agree to participate in and contribute their fair share
to the Cook Street extension project (continuation of Cook Street to
Interstate 10) when requested.
10. Applicant shall provide a minimum of 900 cubic feet of on -site retention
area for storm and nuisance water storage purposes.

City Fire Marshal:
1. The Fire Department is required to set a minimum fire flow for the
remodel or construction of all commercial buildings per Uniform Fire Code
Section 10.301C.
2. Provide, or show there exists a water system capable of providing a
potential fire flow of 3000 gpm and the actual fire flow available from
any one hydrant connected to any given water main shall be 1500 gpm for 2
hours duration at 20 psi residual operating pressure.
3. A fire flow of 3000 gpm for a 3 hour duration at 20 psi residual operating
pressure must be available before any combustible material is placed on
the job site.
4. The required fire flow shall be available from a Super hydrant(s) (6" x
4" x 2-1/2" x 2-1/2"), located not less than 25' nor more than 150' from
any portion of the buildings(s) as measured along approved vehicular
travelways. Hydrants installed below 3000' elevation shall be of the
"wet barrel" type.
5. Prior to the application for a building permit, the developer shall
furnish the original and two copies of the water system plan to the
County Fire Department for review. No building permit shall be issued
until the water system plan has been approved by the County Fire Chief.
Upon approval, the original will be returned. One copy will be sent to
the responsible inspecting authority.
Plans shall conform to fire hydrant types, location and spacing, and the
system shall meet the fire flow requirements. Plans shall be signed by a
Registered Civil Engineer and may be signed by the local water company
with the following certification: "I certify that the design of the
water system is in accordance with the requirements prescribed by the
Riverside County Fire Department.
6. Comply with Title 19 of the California Administrative Code.
7. Install a complete fire sprinkler system per NFPA 13. The post indicator
valve and fire department connection shall be located to the front, not
less than 25' from the building and within 50' of an approved hydrant.
8. Install a fire alarm (waterflow) as required by the Uniform Building
Code, 3803, for sprinkler system.
9. Install tamper alarm on supply valve for sprinkler systems P.I.V. must
also ring outside alarm bell.
10. Certain designated areas will be required to be maintained as fire lanes.

11. Install portable fire extinguishers per NFPA, Pamphlet #10, but not less.
12. Occupancy separation will be required as per UBC Section 503.
13. In order to be classed as a B-2 occupancy storage requirements must be
less than UBC Table 9A limits, otherwise building will be a H occupancy.
14. Install Panic Hardware and Exit signs as per Chapter 33, Sections 3320 of
the Uniform Building Code.
15. Contact the Fire Department for a final inspection prior to occupancy.
