HomeMy WebLinkAboutRes No 1323PLANNING cx iissION RESOLUTION NO. 1323 A RESOLUTION OF THE PLANNING OUAAISSION OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING A REQUEST BY CHERYL DAVIS HELM FOR APPROVAL OF A CONDITIONAL USE PERMIT TO ALLOW USE OF A 6800 SQUARE FOOT RESTAURANT WITHIN A COMMERCIAL BUILDING AT THE SOUTHEAST CORNER OF COOK STREET AND COUNTRY CLUB DRIVE. CASE NO. CUP 88-11 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 6th day of December, 1988, hold a duly noticed public hearing to consider the request of C ERYL DAVIS HELM for approval of a conditional use permit to allow use of a 6800 square foot restaurant within a commercial building at the southeast corner of Cook Street and Country Club Drive; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning camtission did find the following facts and reasons to exist to justify the granting of said conditional use permit: 1. The size and nature of the proposed restaurant is incccnpatible with and will be detrimental to the residential uses in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Conditional Use Permit 88-11 is hereby denied. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 6th day of December, 1988, by the following vote, to wit: AYES: DOWNS, LADLOW, RICHARDS, WHITLOCK, AND ERWOOD NOES: NONE ABSENT: NONE ABSTAIN: NONE RICHARD ERWOOD, Chairman ATTEST: RAMON A.
