HomeMy WebLinkAboutRes No 1325PLANNING COMMISSION RESOLUTION NO. 1325 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND APPROVING A TENTATIVE PARCFJ, MAP CREATING THREE PARCELS OUT OF ONE ON THE SOUTH SIDE OF HOVLEY LANE BETWEEN COOK STREET AND PORTOLA AVENUE. CASE NO. PM 22794 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 20th day of December, 1988, hold a duly noticed public hearing to consider the request of J.E. BUTLER & ASSOCIATES for the above mentioned project; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that this parcel has been previously assessed under GPA 87-6, C/Z 87-13 and PP 87-37 and, therefore, no further documentation is deemed necessary; and WHEREAS, at said public hearing, upon hearing and considering all testimony and argxnents, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify recam ending approval of the parcel map: 1. That the proposed map is consistent with applicable general and specific plans. 2. That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. 3. That the site is physically suitable for the type of development. 4. That the site is physically suitable for the type of development. 5. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. 6. That the design of the subdivision or the type of improvements is not likely to cause serious public health problems. 7. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. PLANNING CaVISSION RESOLUTION NO. 1325 2. A11 conditions of PP 87-37, GPA 87-6, and C/Z 87-13 and the development agreement between the City of Palm Desert and Cook Hovley Street Associates shall apply to this parcel map. Deportment of Public Works: 1. A11 conditions of approval specified in City Council Resolution No. 88-98 (PP 87-37) shall be applicable to this map. /tm 3
