HomeMy WebLinkAboutRes No 1329RESOLUTION NO. 1329 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING A REQUEST FOR APPROVAL OF A GENERAL PLAN AMENDMENT, ZONE CHANGE AND PRECISE PLAN TO ALLOW DEMOLITION OF THREE EXISTING HOMES AND CONSTRUCTION OF A 21,450 SQUARE FOOT OFFICE PROJECT LOCATED AT THE SOUTHWEST CORNER OF FRED WARING DRIVE AND SAN LUIS DRIVE. CASE NO: GPA 88-2, C/Z 88-2 AND PP 88-10 AMENDMENT WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 17th day of January, 1989 hold a duly noticed public hearing to consider the request by RAY LACERTE for the above mentioned project. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested person desiring to be heard, said commission did find the following facts and reasons to exist to justify their decision. 1. The proposed amendment is not consistent with the intent of the district due to its relation with the surrounding residential area. 2. The plan will substantially depreciate property values in the area by replacing compatible uses with an incanpatible structure due to the intensity and its size. 3. The building mass is not in keeping with the residential character of the area. 4. The architecture is not consistent with the residential character of the area. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That it hereby does deny the above described project based on the previous listed findings. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 17th day of January, 1989, by the following , vote, to wit: AYES: DOWNS, RICHARDS, WHITLOCK, AND ERWOOD NOES: NONE ABSENT: LADLOW ABSTAIN: NONE A'ii1 ST: if ,..
