A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, APPROVING A
NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND
CONDITIONAL USE PERMIT FOR A 5470 SQUARE FOOT
EXPANSION AND FACADE REMODEL OF A CCNMERCIAL
COMPLEX ON THE NORTH SIDE OF EL PASEO, 200 I'hEi'
EAST OF HIGHWAY 74.
CASE NO. CUP 89-4
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 4th day of April, 1989, hold a duly noticed public hearing to
consider the request by FRED A. FERN for approval of a negative declaration of
environmental impact and conditional use permit for a 5470 square foot
expansion and facade remodel of a carmercial complex on the north side of El
Paseo, 200 feet east of Highway 74; and
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedure for Implementation of the California Environmental
Quality Act, Resolution No. 80-89," in that the director of community
development has determined that the project will not have an adverse impact on
the environment and a negative declaration has been prepared; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said planning commission did find the following facts and reasons to
exist to justify their actions:
1. The proposed remodel will significantly improve the building's
ability to attract and sustain high quality retail tenants consistent
with the goals of the Commercial Core Area Specific Plan and the
standards of the,C-1 zone.
2. The proposed expansion as mitigated by the availability of off -site
employee parking will not adversely impact parking operation or
general availability in the vicinity.
3. The proposed remodel is compatible and will compliment surrounding
development and will not be detrimental to the public health, safety,
or general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. That a Negative Declaration of Environmental Impact and CUP 89-4 are
hereby approved, subject to attached conditions.

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 4th day of April, 1989, by the following J
vote, to wit:

Department of Community Development:
1. The development of the property shall conform substantially with exhibits
on file with the department of community development, as modified by the
following conditions.
2. Prior to the issuance of a building permit for construction of any uses
contemplated by this approval, the applicant shall first complete all the
procedural requirements of the city which include, but are not limited to,
architectural commission and building permit procedures.
3. Construction of a portion of said project shall camience within one year
from the date of final approval unless a time extension is granted,
otherwise said approval shall become null, void and of no effect
whatsoever.
4. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
municipal ordinances and stated and federal statutes now in force, or
which hereafter may be in force.
5. Prior to issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain permits
and/or clearance from the following agencies:
Riverside County Department of Health
Palm Desert Architectural Commission
City Fire Marshal
Coachella Valley Water District
Palm Desert Property Owner's Association
6. That prior to issuance of building permit the owner (developer) provide
the city with evidence that he has paid the required school mitigation
fee.
7. An effective employee parking program shall be devised and enforced to
divert 22 cars from the project lot to the El Paseo Collection South lot.
8. The project shall be subject to Chapter 25.29 of the Zoning Ordinance
restricting all El Paseo fronting spaces to pedestrian oriented retail and
service.

9. No restaurants or other high parking uses with greater than one space per
250 square feet shall occupy any suite within the remodeled buildings.
10. Windows shall be installed prior to building final.
11. The expansion shall be reduced the equivalent of the area needed to
acccoplish the architectural changes to the front. This reduction shall
be no less than 50%.

of a commercial complex on the north side of El Paseo, 200 feet east of Highway
74.
The Director of the Department of Community iity Development, City of Palm Desert,
California, has found that the described project will not have a significant
effect on the environment. A copy of the Initial Study has been attached to
ant the reasons in support of this finding. Mitigation measures, if any,
included in the project to avoid potentially significant effects, may also be
found attached.
