HomeMy WebLinkAboutRes No 1348PLANNING CENDIISSICINI RESOLUTION N3. 1348 A RESOLUTION OF THE PLANNING COtvMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A PRECISE PLAN OF DESIGN FOR A FtXJR UNIT APARTMENT COMPLEX AND FRONT YARD ADJUSTMENT ON THE SOUTH SIDE OF SHADOW MOUNTAIN DRIVE, 400 H zf WEST OF PORTOLA AVENUE. CASE NO. PP 89-7, ADJ 89-2 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 18th day of April, 1989, hold a duly noticed public hearing to consider the request of JAMES LANDON for above described project. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project will have no possible significant effect on the environment and is thereby exempt. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify granting approval of said precise plan: %or 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. 4. Strict interpretation of the ordinance creates exceptional difficulties of rights enjoyed by others. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case; 2. That approval of Precise Plan is hereby granted for reasons subject to the attached conditions. PP 89-7 Department of Oanmuiity Development 1. The development of the property shall conform substantially with exhibits on file with the department of community development, as modified by the following conditions: 2. Construction of a portion of said project shall mice within one year from the date of second reading before city council, or one year after first reading unless an extension of time is granted; otherwise said approval shall became null, void and of no effect whatsoever. 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in adOition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Department of Public Works Palm Desert Fire Marshal Coachella Valley Water District Palm Desert Architectural Commission Evidence of said permit of clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Applicant shall pay applicable development fees (i.e. school, art in public places). Department of Public Works 1. Drainage fees, in accordance with Section 26.49 of the Palm Desert Municipal Code and Palm Desert Ordinance Number 507, shall be paid prior to issuance of grading permit. 2. Storm drain construction shall be contingent upon a drainage study prepared by a civil engineer that is reviewed and approved by the Department of Public Works. 3 PLANNING CaglISSION RESOLIMON NJ. 1348 3. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17 and 79-55, shall be paid prior to issuance of grading permit. 4. Full public improvements, as required by Sections 26.44 and 26.40 of the Palm Desert Municipal Code, shall be installed in accordance with applicable City standards. 5. As required under Palm Desert Municipal Code Section 26.28, and in accordance with Sections 26.40 and 26.44, complete improvement plans and specifications shall be submitted to the Director of Public Works for checking and approval before construction of any improvements is commenced. Offsite improvement plans to be approved by Public Works Department and a surety posted to guarantee the installation of required offsite improvements prior to issuance of grading permit. Such offsite improvements shall include, but not limited to, curb and gutter, asphalt paving and concrete sidewalk in an appropriate size and configuration. "As -built" plans shall be submitted to, and approved by, the Director of Public Works prior to the acceptance of the improvements by the City. 6. All private driveways and parking lots shall be inspected by the engineering department and a standard inspection fee shall be paid prior to grading permit issuance. 7. Landscaping maintenance on Shadow Mountain Drive shall be provided by the property owner. 8. As required under Section 12.16 and 26.44 of the Palm Desert Municipal Code, all existing utilities shall be undergrounded per each respective utility district's recommendation. If determined to be unfeasible, applicant shall agree to participate in any future utility undeiyruunding district. 9. In accordance with Palm Desert Municipal Code Section 26.44, complete grading plans and specifications shall be submitted to the Director of Public Works for checking and approval prior to issuance of any permits. 10. Size, number and location of driveways to Public Works specifications with only two driveway approach(es) to be allowed to serve this property. 11. Any and all off -site improvements shall be preceded by the approval of plans and the issuance of valid encroachment permit(s) by the Department of Public Works. 12. A complete preliminary soils investigation, conducted by a registered soils engineer, shall be submitted to and approved by the Department of Public Works prior to issuance of the grading permit. 4 PLANNIM CCMISSICN NO. 1348 13. Pad elevations, as shown on the preliminary grading plan are subject to review and modification in accordance with Section 27 of the Palm Desert Municipal Code. Fire Marshal 1. The Fire Department is required to set a minimum fire flow for the remodel of construction of all commercial buildings per Uniform Fire Code Section 10.301C. 2. Install a complete fire sprinkler system per NFPA 13R.System may use CPVC in non exposed areas. 3. Install a fie alarm (waterflow) as required by the Uniform Building Code, 3803, for sprinkler system. 4. Install tamper alarm on supply valve for sprinkler systems. 5. Certain designated areas will be required to be maintained as fire lanes. 6. Install portable fire extinguishers per NFPA, Pamphlet #10, but not less than 2A10BC in rating, so that no interior point on any unit is more than 75 feet from an extinguisher. 7. Occupancy separation will be required as per the Uniform Building Code Section 503. 8. OTHER: We are recommending driveway widths to be 20 feet instead of 16 feet shown on plot plan. 9. Contact the Fire Department for a final inspection prior to occupancy. /fr 5
