HomeMy WebLinkAboutRes No 1350PLANNING COMMISSION RESOLUTION NO. 1350 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOM"ENDING TO THE CITY COUNCIL APPROVAL OF A NEGATIVE DECLARATION OF ENVIRONIIMENTAL IMPACTAND CHANGE OF ZONE FROM R-1 (SINGLE FAMILY RESIDENTIAL) TO P (PUBLIC/INSTITUTION) FOR 3.2 ACRES AT THE NORTHEAST CORNER OF PORTOLA AVENUE AND FAIRWAY DRIVE. CASE NO. C/Z 89-4 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 18th day of April, 1989, hold a duly noticed public hearing and continued public hearing on May 2, 1989, to consider approval of a negative declaration of environmental impact and change of zone from R-1 to P for 3.2 acres, more particularly described as: APN 625-182-011 WHEREAS, said application has ccxnplied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project will not have an adverse impact on the environment and a negative declaration of environmental impact has been prepared; and WHEREAS, at said public hearing, upon hearing and considering all "' testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts to justify a recommendation of approval: 1. The proposed change of zone is consistent with Palm Desert General Plan for the area. 2. A church and its ancillary uses are permitted in both the R-1 and P zones. The land use will not change as a result of the change of zone. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That a negative declaration of environmental impact, Exhibit "A", is hereby recommended for approval. 3. That Exhibit "B" attached hereto delineating the area and the proposed zoning for the area is hereby recommended for approval. NEGATIVE DBCLARATICN CASE NOS: C/Z 89-4 and CUP 89-2 APPLICANT/PROJECT SPONSOR: Hope Lutheran Church 45-900 Portola Avenue Palm Desert, CA 92260 PROJECT DESCRIPTICN/LOCATION: 16,100 square foot expansion of the existing church facility at the northeast corner of Portola Avenue and Fairway Drive. The Director of the Department of Community Development, City of Palm Desert, California, has found that the described project will not have a significant effect on the environment. A copy of the Initial Study has been attached to document the reasons in support of this finding. Mitigation measures, if any, included in the project to avoid potentially significant effects, may also be found attached. RAMON A.
