A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING AN AMENDMENT TO A PRECISE
PLAN OF DESIGN AND TENTATIVE TRACT MAP TO SUBDIVIDE 25
ACRES OF LAND INTO 90 SINGLE FAMILY LOTS PREVIOUSLY APPROVED
AS 224 APAR'IMENI'S .
CASE NOS. PP 87-20 AMENDMENT AND TT 24539
WHEREAS, the Planning Cannission of the City of Palm Desert, California,
did on the 18th day of April, 1989, hold a duly noticed public hearing and
continued public hearing on May 2, 1989, to consider a request by TRIAD PACIFIC
DEVELOPMENT for the above mentioned project; and
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedure for Implementation of the California Environmental
Quality Act, Resolution No. 80-89," in that the director of community
development has determined that the project will not have an adverse impact on
the environment and a negative declaration of environmental impact is hereby
certified; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said planning commission did find the following facts and reasons to
exist to justify the granting of said amendment to the precise plan and to
approve the tentative tract map:
a. The design of the precise plan will not substantially depreciate
property values nor be materially injurious to properties or
improvements in the vicinity.
b. ahe precise plan will not unreasonably interfere with the use of and
enjoyment of property in the vicinity by the occupants thereof for
lawful purposes.
c. 11e precise plan will not endanger the public peace, health, safety,
or general welfare.
d. That the proposed map is consistent with applicable general and
specific plans.
e. That the design or improvement of the proposed subdivision is
consistent with applicable general and specific plans.
f. That the site is physically suitable for the type of development.
g. That the site is physically suitable for the proposed density of
developnen t .
h. That the design of the subdivision or the proposed improvements are
not likely to cause substantial environmental damage or substantially
and avoidably injure fish or wildlife or their habitat.
i. That the design of the subdivision or the type of improvements is not
likely to cause serious public health problems.
j . That the design of the subdivision or the type of improvements will
not conflict wit:lh easements, acquired by the public at large, for
access through or use of property within the proposed subdivision.

WHEREAS, in the review of this tentative tract map the planning commission
has considered the effect of the contemplated action on the housing needs of
the region for purposes of balancing these needs against the public service
needs of the residents of the City of Palm Desert and its environs, with
available fiscal and environmental resources.
NOW, IHEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the ccuud.ssion in this case.
2. That it does hereby approve the above described Tentative Tract Map
No. 24539, for the reasons set forth in this resolution and subject
to the attached conditions.
FURTHER, BE IT RESOLVED that the conditions of approval do include a
requirement that the applicant agree to ccamply with the requirements of Article
26.48 of the City of Palm Desert Subdivision Ordinance. In return, the City
agrees to use said fees for park purposes in conformance with an adopted master
plan, within five (5) years of the recordation of the final map.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Carliiission, held on this 2nd day of May, 1989, by the following vote,
to wit:

Department of Ctimnmity Development:
1. The development of the property shall conform substantially with exhibits
on file with the department of community development/planning, as modified
by the following conditions.
2. Construction of a portion of said project shall commence within one year
from the date of final approval unless an extension of time is granted;
otherwise said approval shall become null, void and of no effect
whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
municipal ordinances and state and federal statutes now in force, or which
hereafter may be in force.
4. Prior to issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain permits
and/or clearance from the following agencies:
Coachella Valley Water District
Palm Desert Architectural Commission
City Fire Marshal
Public Works Deparbment
Palm Desert Water & Services District
Palm Desert Disposal
Department of Building & Safety
Evidence of said permit or clearance Loan the above agencies shall be
presented to the department of building and safety at the time of issuance
of a building permit for the use contemplated herewith.
5. Applicant agrees to pay a future reasonable assessment for Cook Street
improvements including bridges at Interstate 10 an the Whitewater Channel.
6. Payment of lizard mitigation fees shall be paid prior to issuance of
grading permit.
7. All future occupants of the building shall comply with parking
requirements of the ordinance.
8. PLuject shall be subject to Art in Public Places fee per Ordinance No.
473.

9. Trash provisions shall be approved by applicable trash company and city
prior to issuance of building permit. ri
10. Project shall pay school impact mitigation fees as arranged with the
Desert Sands Unified School District.
11. A detailed parking lot and building lighting plan shall be submitted to
staff for approval, subject to applicable lighting standards, plan to be
prepared by a qualified lighting engineer.
12. All roof -mounted mechanical equipuent shall be screened faun all sides
with materials similar to building walls.
13. All on -site utilities, including cable television, shall be placed
underground and shall be completely concealed from view except certain
appurtenances as may be approved by the director of community development.
14. Only delivery diesel trucks built after 1974 shall be used. A $200.00
fine shall be imposed for each violation.
15. All mitigation measures identified in the Environmental Impact Report,
prepared November, 1987, shall be met unless specifically waived by the
Planning Cautrission and/or City Council.
16. Applicant shall pay fire facilities fees to offset the costs of increased
services.
17. Applicant shall pay drainage fees to offset the cost of drainage
improvements.
18. `Twenty-five year storm flows shall be retained on -site.
19. Mitigation measures for blowsand prevention shall be provided.
20. Applicant shall contribute to signalization funding.
21. Applicant shall provide a bus stop with improvements, a waiting shelter,
bench and trash receptacle. Design of said bus shelter shall be approved
by the Palm Desert Architectural Commission.
22. Applicant shall provide parking facilities for bicycles to meet air
quality mitigation measures and energy conservation concerns and tie in
with provided bicycle path.
23. Architectural treahuetits shall be provided on residential units to reduce
noise to a level not to exceed 65 ldn (approximately 195' from Cook Street
and 117' from Iiovley Lane) .

24. Water efficient landscaping shall be provided as per approved plan.
25. Applicant shall provide an eight foot wide meandering bicycle path in the
landscape setback on the westerly and southern perimeter of the project.
26. All Cook Street improvements are to be installed during phase 1 of
construction, of either residential or office, due to the "urgency" of the
improvements.
27. Single family lot building setbacks shall conform to Chapter 25.16.050 of
the Palm Desert Municipal Code.
28. The applicant shall establish a lighting and landscape district per 1972
Light and Landscape Maintenance Act whereby maintenance of said open space
area shall be assessed to the property under this application.
29. Only one single family hone shall be built on each lot of the subdivision
and the applicant shall not object to a city initiated change of zone to
PR-3.6.
30. The applicant shall include a mini park and mature landscaping in the
retention area landscape design. Said landscape design shall be reviewed
and approved by the planning and/or architectural commissions.
Department of Public Works:
1. Drainage fees, in accordance with Section 26.49 of the Palm Desert
Municipal Code and Palm Desert Ordinance No. 507, shall be paid prior to
recordation of the final map.
2. Drainage facilities shall be provided, per ordinance no. 218 and the
Master Drainage Plan, to the specifications of the director of public
works.
3. Storm drain construction shall be contingent upon a drainage study
prepared by a registered civil engineer that is reviewed and approved by
the department of public works prior to start of construction.
4. Signalization fees, in accordance with City of Palm Desert Resolution Nos.
79-17 and 79-55, shall be paid prior to recordation of final map.
5. Full public improvements, as required by Sections 26.40 and 26.44 of the
Palm Desert Municipal Code, shall be installed in accordance with
applicable city standards.
6. As required under Palm Desert Municipal Code Section 26.28, and in
accordance with Sections 26.40 and 26.44, complete improvement plans and
specifications shall be submitted to the director of public works for

checking approval before construction of any improvements is commenced.
Offsite improvement plans to be approved by the public works department
and a surety posted to guarantee the installation of required offsite
improvements prior to recordation of final map. Such offsite improvements
shall include, but not be limited to, curb and gutter, asphalt paving and
concrete sidewalk in an appropriate size and configuration and provisions
for a deceleration lane at the Cook Street project entry. "As -built"
plans shall be submitted to, and approved by, the director of public works
prior to the acceptance of the improvements by the city.
7. Improvement plans for water and sewer systems shall be approved by the
respective service districts with "as -built" plans submitted to the
department of public works prior to project final.
8. All public improvements shall be inspected by the department of public
works and a standard inspection fee shall be paid prior to issuance of
grading permits.
9. Landscaping maintenance on Via Cinta, Hovley Lane and Cook Street shall be
provided by the property owners.
10. Waiver of access to Cook Street, Hovley Lane and Via Cinta except at
approved locations shall be granted on the final map.
11. In accordance with Palm Desert Municipal Code Section 26.44, complete
grading plans and specifications shall be submitted to the director of
public works for checking and approval prior to issuance of any permits.
12. In accordance with the Circulation Network of the City of Palm Desert's
General Plan, installation of one-half landscaped median island in Cook
Street shall be provided. A cash payment in lieu of actual installation
may be submitted at the option of the director of public works.
13. Traffic safety striping on Cook Street shall be provided to 'the
specifications of the director of public works. A traffic conLrul plan
must be subnitted to, and approved by, the director of public works prior
to the placement of any pavement markings.
14. Full improvements of interior streets based on residential street
standards in accordance with Section 26.40 of the Palm Desert Municipal
Code shall be provided.
15. Canplete tract map shall be submitted as required by ordinance to the
director of public works for checking and approval and be recorded before
issuance of any permits.
16. Any and all offsite improvements shall be preceded by the approval of

plans and the issuance of valid encroachment permits by the department of
public works.
17. A complete preliminary soils investigation, conducted by a registered
soils engineer, shall be submitted to, and approved by, the department of
public works prior to the issuance of a grading permit.
18. Pad elevations, as shown on the tentative map are subject to review and
modification in accordance with Chapter 27 of the Palm Desert Municipal
Code.
19. Public street access shall be limited to one ingress/egress location on
Cook Street and one ingress/egress location on Via Cinta.
20. No additional Cook Street/Howley Lane access locations for the adjacent
office complex shall be permitted under this approval.
21. Applicant shall agree to contribute their fair share to the assessed costs
for the Cook Street Extension and Bridge Fund.
Fire Marshal:
1. Install a water system capable of delivering 3000 GPM fire flow from any
fire hydrant for a three hour duration in addition to domestic supply.
The computation shall be based upon a minimum of 20 psi residual operating
pressure in the supply main from which the flow is measured at the time of
measurement.
2. Install Riverside County super fire hydrants so that no point of any
building is more than 200 feet fran a fire hydrant measured along approved
vehicular travel ways.
a. exterior surface of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
b. curbs shall be painted red 15 feet in either direction from each
hydrant.
c. hydrants shall not be located closer than 25 feet to any building.
3. Prior to issuance of a building penult, the developer shall furnish the
original and three copies of the water system plan to the fire marshal for
review. Upon approval, one copy will be sent to the building department
and the original will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer and
approved by the water ccinpany with the following certification: "I

certify that the design of the water system in PP 87-20 is in accordance
with the requirements prescribed by the fire marshal."
5. Prior to delivery of canbustible materials to the building site, the
required water system shall be installed, operating and delivering the
required flow.
6. Additional fire protection requirements may be necessary when the
applicant submits specific plans for consideration and approval.
7. All buildings over 5,000 square feet require an approved fire sprinkler
system.
8. Residential portion requires 2500 GPM fire flow for 2 hour duration and
250 feet spacing on fire hydrants.
City Osu it Q:xxliticns:
1. Applicant shall be responsible for installation of traffic signal, per
department of public works approval, at the intersection of Hovley Lane
and Cook Street. If the cost of signalization exceed applicant's
signalization fees, a reimbursement agreement at zero interest shall be
executed to reimburse applicant.
2. If project does not cannence within one year fLun the date of approval,
the City of Palm Desert may initiate proceedings to return the zoning to
its current designation.
