HomeMy WebLinkAboutRes No 1360PLANNING CIMISSION RESOLUTION NO. 1360 A RESOLUTION OF THE PLANNING COPMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING REQUEST OF A CHANGE OF ZONE FROM R-1 (SINGLE FAMILY RESIDENTIAL) TO R-3 (8,000) FOR A LOT AT THE NORTHWEST CORNER OF LARREA STREET AND GARDEN SQUARE. CASE NO. C/Z 89-5 (THIELMAN) WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 20th day of June, 1989, hold a duly noticed public hearing, which was continued to June 6, 1989, to consider approval of a change of zone from R- 1 to R-3 (8,000) for property more particularly described as: APN 625-132-005 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the change of zone is a class 5 categorical exemption; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments of all interested persons desiring to be heard, said planning commission did find the following facts to justify denial: 1. Approval of the requested change of zone would increase traffic congestion of street which has no secondary exit. 2. Increased traffic congestion would endanger the lives of children. 3. Increased traffic would increase air pollution and impact on the residential ccmnunity. 4. Increased traffic to the neighborhood would result in additional noise disturbing the residential neighborhood. 5. As a result of items 1 through 4 residential property values could be negatively impacted. 6. As a result of items 1 through 4 the residential character of the area could be negatively impacted. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That the requested change of zone, Case No. C/Z 89-5, is hereby denied for the six (6) reasons delineated above.
