A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, DENYING A
GENERAL PLAN AMENDMENT FROM MEDIUM DENSITY
RESIDENTIAL TO OFFICE PROFESSIONAL, CHANGE OF
ZONE FROM PR-5 N S.P. TO O.P., PRECISE PLAN
APPROVAL OF A MIXED USE RESTAURANT/OFFICE PROJECT
FOR AN 11.3 ACRE SITE ON THE NORTH SIDE OF
HIGHWAY 111 AT THE EAST CITY LIMIT.
CASE NOS. GPA 89-4, C/Z 89-9, PP 89-9
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 20th day of June, 1989, hold a duly noticed public hearing which was
continued to July 18, 1989, to consider a request by BERNARD DEBONNE, for
approval of a negative declaration of environmental impact, general plan
amendment from medium density residential to office professional, change of
zone from PR-5 N S.P. to O.P., precise plan approval of a mixed use
restaurant/office project for an 11.3 acre site on the north side of Highway
111 at the east city limit; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments of all persons desiring to be heard, said planning
commission did find the following facts to justify their actions:
GENERAL PLAN AMENDMENT AND CHANGE OF ZONE:
1. The proposed change of land use from residential to office
professional is not appropriate due to the limited access from
Highway 111 available to the site.
2. Establishing over 100,000 square feet of office space in this
location is not an appropriate land use.
PRECISE PLAN:
1. Without the approval of both the general plan amendment and the
change of zone the necessary finding cannot be made that the precise
plan is consistent with the general plan and the zoning ordinance.
2. The applicant does not have easement rights to connect to the Embassy
Suites property and without these easements traffic circulation on
the site is unacceptable.
3. Approving an 11,000 square foot restaurant without knowing who the
operator will be, what type of restaurant it will be and the quality
of the proposed restaurant is not appropriate.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.

2. That GPA 89-4, C/Z 89-9, and PP 89-9 are hereby denied for the
reasons delineated above, herein.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 1st, day of August, 1989, by the following
vote, to wit:
