A RESOLUTION OF THE PLANNING CCNNLISSION OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING A 105 LOT TENTATIVE TRACT MAP
AND NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT ON 29.34
ACRES ON THE NORTH SIDE OF COUNTRY CLUB DRIVE, 1000 HEE
EAST OF PORTOLA AVENUE.
CASE NO. TT 24923
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 15th day of August, 1989, hold a duly noticed public hearing to
consider a request by UNITED SAVINGS BANK for approval of a negative
declaration of environmental impact and a 105 lot single-family subdivision on
29.34 acres within the PR-5 zone on the north side of Country Club Drive, 1000
feet east of Portola Avenue; and
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedure for Implementation of the California Environmental
Quality Act, Resolution No. 80-89," in that the director of community
development has determined that the project will not have a significant adverse
impact on the environment and a negative declaration has been prepared; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said planning commission did find the following facts to justify their
actions, as described below:
1. The proposed map, its design, improvements, type of development, and
density are consistent with the State Subdivision Map Act, the Palm
Desert Subdivision and Zoning Ordinance, and General Plan.
2. The map has been designed as part of a master plan developed in
cooperation with adjacent property owners which implements specific
city goals and objectives for the area.
3. The design of the subdivision and required mitigation measures insure
that the project will not result in environmental damage, injure fish
or wildlife, degrade water quality or create public health problems.
4. The map will not conflict with public easements.
5. The map will allow unrestricted solar access to all lots.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. That a Negative Declaration of Environmental Impact Exhibit "A" and
TT 24923 on file in the department of community development/planning
is hereby approved, subject to conditions.

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 15th day of August, 1989, by the following
vote, to wit:

CONDITIONS OF APPROVAL
CASE ND. TT 24923
Department of clxmu uty Developmegit/Planning:
1. The development of the property shall conform substantially with exhibits
on file with the department of community development/planning, as modified
by the following conditions.
2. Recordation of the final map shall occur within 24 months from the date of
this approval unless an extension of time is granted; otherwise said
approval shall became null, void and of no effect whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
municipal ordinances and state and federal statutes now in force, or which
hereafter may be in force.
4. Prior to issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain permits
and/or clearance from the following agencies:
Coachella Valley Water District
Palm Desert Architectural Commission
City Fire Marshal
Public Works Departanent
Evidence of said permit or clearance from the above agencies shall be
presented to the department of building and safety at the time of issuance
of a building permit for the use contemplated herewith.
5. The following development standards shall apply:
A. Building Height.
The following lots will be restricted to one story: 35 through 55,
68, 69, 81, 82, 93, 94, and 105. Two story construction shall be
permitted on the balance of the tract.
One story height = 18 feet maximum
Two story height = 24 feet maximum
B. Setbacks.
One story: Front = 20 feet
Rear = 15 feet
Sides = 14 feet combined, no side less than 5 feet
Coverage = 35%

Two story:
Front = 20 feet
Rear = 25 feet
Sides = 15 foot minimum, building separation 30 foot
minimum
Coverage = 25%
6. Applicant shall execute mutual access agreements with adjacent property
owners.
7. Development shall be subject to Coachella Valley Fringe -Toed Lizard
mitigation fee of $600/acre.
Department of Public Wb ks:
1. Drainage fees, in accordance with Section 26.49 of the Palm Desert
Municipal Code and Palm Desert Ordinance Number 507, shall be paid prior
to recordation of final map.
2. Drainage facilities, as designated within the Northside Area Master
Drainage Plan, shall be provided to the specifications of the director of
public works.
3. Storm drain construction shall be contingent upon a drainage study
prepared by a registered civil engineer that is reviewed and approved by
the department of public works prior to start of construction.
4. Signalization fees, in accordance with City of Palm Desert Resolution Nos.
79-17 and 79-55, shall be paid prior to recordation of final map.
5. Full public improvements, as required by Sections 26.40 and 26.44 of the
Palm Desert Municipal Code, shall be installed in accordance with
applicable city standards.
6. As required under Palm Desert Municipal Code Section 26.28, and in
accordance with Section 26.28, and in accordance with Sections 26.40 and
26.44, complete improvement plans and specificaticns shall be submitted to
the director of public works for checking approval before construction of
any improvements is commenced. Offsite improvement plans to be approved
by the public works department and a surety posted to guarantee the
installation of required offsite improvements prior to recordation of
final map. Such offsite improvements shall include, but not be limited
to, curb and gutter, asphalt paving and concrete sidewalk in an
appropriate size and configuration, and the installation of a deceleration
lane for west bound traffic entering the project. "As -built" plans shall
be submitted to, and approved by, the director of public works prior to
acceptance of the improvements by the city.

7. Improovement plans for water and sewer systems shall be approved by the
respective service districts with "as -built" plans submitted to the
department of public works prior to project final.
8. All public improvements shall be inspected by the department of public
works and a standard inspection fee shall be paid prior to issuance of
grading permits.
9. Landscaping maintenance for the individual properties shall be provided by
the property owners. The subdivider shall provide for the formation of a
landscape maintenance district for the maintenance of proposed landscaping
along the Country Club Drive property frontage.
10. In accordance with Palm Desert Municipal Code Section 26.44, complete
grading plans and specifications shall be submitted to the director of
public works for checking and approval prior to issuance of any permits.
11. As required by Sections 26.32 and 26.44 of the Palm Desert Municipal Code,
and in accordance with the Circulation Network of the City's General Plan
half -street right-of-way at 55 feet on Country Club Drive and 30 feet on
"C" street, full right-of-way at 60 feet on "A", "B", and "D" streets, and
50 feet on "E" through "J" circles shall be offered for dedication on the
final map.
12. In accordance with the Circulation Network of the City of Palm Desert's
General Plan, installation of one-half landscaped median island in Country
Club Drive shall be provided. Median island shall be designed so that
left turn egress is prohibited from this project, as well as the property
to the south. A cash payment in lieu of actual installation may be
submitted at the option of the director of public works.
13. Traffic safety striping shall be installed to the specifications of the
Director of Public Works. A traffic control plan must be submitted to,
and approved by, the director of public works prior to the placement of
any pavement markings.
14. Full improvements of interior streets based on residential street
standards in accordance with Section 26.40 of the Palm Desert Municipal
Code shall be provided.
15. Canplete tract map shall be submitted as required by ordinance to the
director of public works for checking and approval and be recorded before
issuance of any permits.
16. Any and all offsite improvements shall be preceded by the approval of
plans and the issuance of valid encroachment permits by the department of
public works.

17. A complete preliminary soils investigation, conducted by a registered
soils engineer, shall be submitted to and approved by the department of
public works prior to the issuance of a grading permit.
18. Pad elevations, as shown on the tentative map, are subject to review and
modification in accordance with Chapter 27 of the Palm Desert Municipal
Code.
19. Waiver of access to Country Club Drive except at approved locations shall
be granted on the final map.
20. Applicant shall agree to participate in and contribute their fair share to
the Cook Street extension and bridge project when requested.
21. In the event that development of this subdivision precedes that of "future
tentative tract 24214", as shown on the tentative map of tract 24923,
provisions shall be made for the construction of a vehicular turn around
at the westerly terminus of "D" street satisfactory to the director of
public works.
22. Retention Basin area, as shown on the tentative tract map, shall be
designed so that it will retain stormwaters associated with a 100 year, 6
hour event and shall include provisions for overflow conditions.
23. Applicant shall provide for the ongoing maintenance of that area
dAsignated on the tentative map as "Retention Basin".
24. Street improvement design for the project shall include provisions for the
relocation of the westerly Gbuntry Club driveway of the property to the
east (Manor Care Facility) to an access location on "A" Drive. Applicant
shall coordinate the design of this access with the subject property owner
and the public works department.
Riverside County Fire Department:
1. Provide or show there exists a water system capable of providing a
potential fire flow of 1500 gpm and the actual fire flow available from
any one hydrant connected to any given water main shall be 1500 gpm for 2
hours duration at 20 psi residual operating pressure.
2. A fire flow of 1500 gpm for a 2 hour duration at 20 psi residual operating
pressure must be available before any combustible material is placed on
the job site.
3. The required fire flow shall be available from a Super hydrant(s) (6" x 4"
x 2-1/2" x 2-1/2"), located not less than 25' nor more than 200' from any
portion of the building(s) as measured along approved vehicular

travelways. Hydrants installed below 3000' elevation shall be of the "wet
barrel" type.
4. Prior to the application for a building permit, the developer shall
furnish a copy of the water system plan to the county fire department for
review. No building permit shall be issued until the water system plan
has been approved by the county fire chief. Upon approval, a letter will
be sent to the responsible inspecting authority.
5. Plans shall conform to fire hydrant types, location and spacing, and the
system shall meet the fire flow requirements. Plans shall be signed by a
registered civil engineer and may be signed by the local water company
with the following certification: "I certify that the design of the water
system is in accordance with the requirements prescribed by the Riverside
Country Fire Department . "
6. Certain designated areas will be required to be maintained as fire lanes.
7. Dead-end roads in excess of 150' shall be provided with a minimum 45'
radius turn -around (55' in industrial developments).
8. Whenever access into private property is controlled through use of gates,
barriers, guard houses or similar means, provisions shall be made to
facilitate access by emergency vehicles in a manner approved by the fire
department. All controlled access devices that are power operated shall
have a radio -controlled over -ride system capable of opening the gate when
activated by a special transmitter located in emergency vehicles. Devices
shall be equipped with backup power facilities to operate in the event of
power failure. All controlled access devices that are not power operated
shall also be approved by the fire department. Minimum opening width
shall be 12', with a minimum vertical clearance of 13'6".
9. Illuminated address signs are required for all new residential housing.
Please contact both the fire department and planning department for
acceptability of proposed signs.

29.34 acres on the north side of Cbuntry Club Drive, 1000 feet east of Portola
Avenue.
The Director of the Department of Community Development, City of Palm Desert,
California, has found that the described project will not have a significant
effect on the environment. A copy of the Initial Study has been attached to
document the reasons in support of this finding. Mitigation measures, if any,
included in the project to avoid potentially significant effects, may also be
found attached.
