A RESOLUTION OF THE PLANNING CCNMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, APPROVING A
TENTATIVE TRACT MAP TO SUBDIVIDE 28 ACRES OF DATE
PALM GROVE INTO 105 LOTS FOR FUTURE SINGLE FAMILY
HOME SITES.
CASE NO: TT 24984
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 15th day of August, 1989, hold a duly noticed public hearing to
consider the request by YOUNG BUILDING CORP. for the above mentioned project;
and
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality
Act, Resolution No. 80-89", in that the director of environmental services has
determined that the project will not have an adverse environmental affect and a
negative declaration is hereby certified.
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be heard, said
planning commission did find the following facts and reasons to exist to
justify approval of the tentative tract map:
(a) That the proposed map is consistent with applicable general and
specific plans.
(b) That the design or improvement of the proposed subdivision is
consistent with applicable general and specific plans.
(c) That the site is physically suitable for the type of development.
(d) That the site is physically suitable for the proposed density of
development.
(e) That the design of the subdivision or the proposed improvements are
not likely to cause substantial environmental damage or substantially
and avoidably injure fish or wildlife or their habitat.
(f) That the design of the subdivision or the type of improvements is not
likely to cause serious public health problems.
(g) That the design of the subdivision or the type of improvements will
not conflict with easements, acquired by the public at large, for
access through or use of property within the proposed subdivision.
NOW, THEREFORE, BE IF RESOLVED by the Planning ng Commission of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case;
2. That it does hereby approve the above described Tentative Tract Map
No. 24984, subject to fulfillment of the attached conditions.

Department of OcmRmity Development:
1. The final map shall conform substantially with the tentative tract map as
modified by the following conditions.
2. Applicant shall obtain clearance fran the following agencies prior to
construction:
Public Works Department
Palm Desert Architectural Review Commission
City Fire Marshal
Coachella Valley Water District
Palm Desert Building & Safety Department
Evidence of said permit or clearance from the above agencies shall be
presented to the department of building and safety at the time of issuance
of a building permit for the use contemplated herewith.
3. The applicant shall pay all applicable fees in accordance with city policy
including those for art in public places.
4. Only one story homes will be built in this project.
5. Development standards for building setbacks shall be according to average
lot size; therefore, required yards will comply with ordinance 25.16.050.
(Twenty feet = front yard, fifteen feet = rear yard, fourteen feet
combined side yard with five foot minimum on either side).
6. Perimeter decorative walls are required at six foot height.
7. A landscape plan shall be submitted for review to the architectural review
commission detailing Deep Canyon landscaping, the Deep Canyon entryway,
and a typical front yard landscape plan, prior to issuance of building
permits.
8. Prior to issuance of building permits the site shall be treated to remove
rodents and pests. The eradication/abatement procedure shall be reviewed
and approved by the California Department of Health Services and
Environmental Management and the Department of Environmental Services.
9. Typical building elevations shall be submitted for review and approval to
the architectural review commission prior to issuance of building permits.

10. The applicant and/or their successor agrees to contribute to the costs of
irrigation for the city's date palm preserve to be located over
approximately six acres at the northeast corner of the civic center site.
11. Street widths shall be reduced to 50' widths per city standards to provide
for a 20' perimeter landscape plan on Deep Canyon Drive.
12. Applicant shall use approximately 25-30 palms on the site. The type of
palm to be designated by the architectural commission and to be at least
10 feet in height.
Department of Public Works:
1. Drainage fees, in accordance with Section 26.49 of the Palm Desert
Municipal Code and Palm Desert Ordinance No. 507, shall be paid prior to
recordation of final map.
2. Drainage facilities, as designated within the Master Drainage Plan shall
be provided to the specifications of the director of public works.
3. Storm drain construction shall be contingent upon a drainage study
prepared by a registered civil engineer that is reviewed and approved by
the department of public works.
4. Signalization fees, in accordance with City of Palm Desert Resolution Nos.
79-17 and 79-55, shall be paid prior to recordation of final map.
5. Full public improvements, as required by Sections 26.40 and 26.44 of the
Palm Desert Municipal Code, shall be installed in accordance with
applicable city standards.
6. As required under Palm Desert Municipal Code Section 26.28, and in
accordance with Sections 26.40 and 26.44, complete improvement plans and
specifications shall be sutxnitted to the director of public works for
checking and approval before construction of any improvements is
commenced. Off -site improvement plans to be approved by the public works
department and a surety posted to guarantee the installation of required
off -site improvements prior to recordation of the final map. Such
off -site improvements shall include, but not be limited to, curb and
gutter, asphalt paving and concrete sidewalk in an appropriate size and
configuration. "As -built" plans shall be submitted to, and approved by,
the director of public works prior to the acceptance of the improvements
by the city.
7. Lnipravement plans for water and sewer systems shall be approved by the
respective service districts with "as -built" plans submitted to the
department of public works prior to the project final.

8. All public improvements shall be inspected by the department of public
works and a standard inspection fee shall be paid prior to recordation of
the final map.
9. Landscaping maintenance for the individual lots shall be provided by the
individual property owners. Landscaping maintenance for the Deep Canyon
Road frontage shall be provided by the project developer until such time
as a landscape maintenance district has been formed. The developer shall
be responsible for the formation of said district.
10. As required under Sections 12.16 and 26.44 of the Palm Desert Municipal
Code, all existing utilities shall be placed underground per each
respective utility district's recommendation. If determined to be
unfeasible, applicant shall agree to participate in any future utility
undergrnunding district.
11. In accordance with Palm Desert Municipal Code Section 26.44, complete
grading plans and specifications shall be submitted to the director of
public works for checking and approval prior to issuance of any permits.
12. As required by Section 26.32 and 26.44 of the Palm Desert Municipal Code,
dedication of street right-of-way at 60 feet on Street "A" and 50 feet on
Streets "B" through "F" shall be offered to the city on the final map.
13. Traffic safety striping on Deep Canyon Road shall be provided to the
specifications of the director of public works. A traffic conUul plan
must be submitted to, and approved by, the director of public works prior
to the placement of any pavement markings.
14. Full improvements of interior streets based on residential street
standards in accordance with Section 26.40 of the Palm Desert Municipal
Code shall be provided.
15. Complete tract map shall be submitted as required by ordinance to the
director of public works for checking and approval and be recorded before
issuance of any permits.
16. Any and all off -site improvements shall be preceded by the approval of
plans and the issuance of valid encroachment permits by the department of
public works.
17. A completed preliminary soils investigation, conducted by a registered
soils engineer, shall be sutanitted to, and approved by, the department of
public works prior to issuance of a grading permit.
18. Pad elevations as shown on the tentative map are subject to review and
modification in accordance with chapter 27 of the Palm Desert Municipal
Code.

19. Waiver of access to Deep Canyon except at approved locations shall be
granted on the final map.
20. Drainage easements as shown on the tentative tract map shall be a minimum
width of 15 feet.
21. Applicant shall provide for the design and construction of drainage
facilities, including easements as may be necessary, to provide for the
continued conveyance of existing surface drainage from the properties
located westerly of the proposed project.
Riverside County Fire wit:
1. Approved Super fire hydrants, (6" x 4" x 2 1/2" x 2 1/2") shall be located
one at each street intersection spaced not more than 400 feet apart in any
direction with no portion of any frontage more than 200 feet from a fire
hydrant. Minimum fire flow shall be 1500 gpm for 2 hours duration at 20
psi.
2. The water mains shall be capable of providing a potential fire flow of
1500 gpm and an actual fire flow available from any one hydrant shall be
1500 gpm for 2 hours duration at 20 psi residual operating pressure.
3. Prior to recordation of the final map, applicant/developer shall furnish
one blueline copy of the water system plans to the fire department for
review. Plans shall conform to the fire hydrant types, location and
spacing, and the system shall meet the fire flow rents. Plans
shall be signed/approved by a registered civil engineer and the local
water company with the following certification: "I certify that the
design of the water system is in accordance with the requirements
prescribed by the Riverside County Fire Department."
4. The required water system including fire hydrants shall be installed and
accepted by the appropriate water agency prior to any combustible building
material being placed on an individual lot.
5. Prior to the recordation of the final map, the applicant/developer shall
agree to provide alternate or secondary access as approved by the fire
department.
6. Whenever access into private property is con oiled through use of gates,
barriers, guard houses or similar means, provision shall be made to
facilitate access by emergency vehicles in a manner approved by the fire
department. All controlled access devices that are power operated shall
have a radio-contiulled over -ride system capable of opening the gate when
activated by a special transmitter located in emergency vehicles. Devices
shall be equipped with backup power facilities to operate in the event of
