PLANNIND CallISSICN RESOLUTION ND. 1380 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL CERTIFICATION OF AN ENVIRONMENTAL IMPACT REPORT AND APPROVAL OF AN AMENDMENT TO THE GENERAL PLAN, COMMERCIAL CORE AREA SPECIFIC PLAN, ZONING MAP, SECTION 25.37 OF THE ZONING ORDINANCE AND DEVELOPMENT AGREEMENT. CASE NOS. GPA 89-1, C/Z 89-1, ZOA 89-1 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 5th day of September, 1989, hold a duly noticed public hearing to consider the request AHMANSON DEVELOPMENT COMPANY for approval of an Environmental Impact Report and approval of an anerxtment to the General Plan, Commercial Core Area Specific Plan, Zoning Map, Section 25.37 of the Zoning Ordinance and Development Agreement; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89" and a Draft Environmental Impact Report has been prepared in compliance with CEQA Guidelines as amended; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to justify a recommendation of approval: A. Environmental Impact Report. 1. The Environmental Impact Report has been completed in compliance with CEQA and adequately addresses the impacts and mitigation measures for the proposed projects. 2. These recatmendations concerning the project are the result of review and consideration of the information contained within the Draft E.I.R. B. General Plan and Commercial Core Area Specific Plan. 1. The proposed regional commercial designations are consistent with the intent and purpose of the general policies for encouraging high quality compatible commercial uses within the Highway 111 commercial core. C. Zoning Map. The proposed zoning map amendments are consistent with the General Plan and Commercial Core Area Specific Plan as amended. PLANNIKU COMMISSION RESOLUTIOi N3. 1380 D. Zoning Ordinance Amendment. The amendment permits the city greater opportunities to enter development agreements, providing greater flexibility in regulating and controlling development as prescribed by State law. E. Development Agreement. The proposed agreement provides the city with additional controls and commitments while providing the developer with long range assurances concerning development requirements. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings ngs of the commission in this case. 2. That the planning commission hereby recommends approval to city council certification of the EIR Exhibit A, General Plan Amendment Exhibit B, Commercial Core Area Specific Plan Exhibit C, Change of Zone Exhibit D, Zoning Ordinance Amendment Exhibit E, and approval of. Amendment No. 5 to the Redevelopment Plan as amended for Project No. 1, as amended of the Agency and making its report and recommendations. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 5th, day of September, 1989, by the following vote, to wit: AYES: DOWNS, JONATHAN, RICHARDS, WHITLOCK, AND ERWOOD NOES: NONE ABSENT: NONE ABSTAIN: NONE ATTEST: RAMON A. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT RECOMMENDING APPROVAL OF AMENDMENT NO. 5 TO THE REDEVELOPMENT PLAN, AS AMENDED, FOR PROJECT NO. 1, AS AMENDED, OF THE AGENCY AND MAKING ITS REPORT AND RECOMMENDATIONS THE PLANNING COMMISSION OF THE CITY OF PALM DESERT HEREBY FINDS, DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: ,gectiQn 1. The Palm Desert Redevelopment Agency has forwarded to the Planning Commission copies of proposed Amendment No. 5 to the Redevelopment Plan, As Amended, for Project Area No. 1, As Amended, of the Agency. The Planning Commission hereby approves such proposed Amendment No. 5, a copy of which is attached hereto as Exhibit A, and hereby recommends that such Amendment No. 5 be approved and adopted by the Agency and the City Council of the City of Palm Desert. ectlon 2. The Planning Commission hereby finds and determines that such proposed Amendment No. 5 is in conformity with the General Plan of the City of Palm Desert, in that such proposed Amendment provides that if any land use or proposed land use within the area covered thereby conforms to the General Plan or Zoning ordinance of the City of Palm Desert, as amended from time to time, then such land use or proposed land use shall be deemed to comply with any and all land use restrictions contained in the Redevelopment Plan, and any prior amendment thereof, notwithstanding any provision, map, figure or diagram contained in the Redevelopment Plan, or any prior amendment hereof, to the "ontrary. section 3.
