A RESOLUTION OF THE PLANNING CCNMISSION OF THE
CITY OF PALM DESERT APPROVING THE SELECTION OF
BOUNDARIES OF PROJECT AREA NO. 3 AND THE
FORMULATION AND PREPARATION OF A PRELIMINARY PLAN
THEREFOR.
THE PLANNING COMMISSION OF THE CITY OF PALM DESERT HEREBY FINDS,
DETERMINES, RESOLVES AND ORDERS AS FOLLU4S:
Section 1. The City Council of the City of Palm Desert has
designated a survey area for redevelopment study purposes. The Community
Redevelopment Law (California Health and Safety Code Section 33000, et seq.)
provides for the planning oammission, with the cooperation of the Palm Desert
Redevelopment Agency, to select a project area from within the boundaries of a
survey area, and to formulate and prepare a preliminary plan for the
redevelopment of the selected project area, and the planning commission has
selected such a project area and has formulated and prepared a preliminary plan
therefor.
Section 2. The planning caimission hereby approves the selection of
Project Area No. 3, which is that certain area within the survey area
designated by the city council and shown on the diagram attached hereto as
Exhibit A.
Section 3. The planning commission hereby approves the "Preliminary
Plan for Project Area No. 3" as formulated and prepared by the planning
oattnission, attached hereto as Exhibit B.
Section 4. The secretary of the planning commission is hereby
authorized and directed to transmit a copy of this resolution to the agency.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Carmission, held on this 5th, day of September, 1989, by the following
vote, to wit:

PRELIMINARY PLAN
FOR PROJECT AREA NO. 3
I. INTRODUCTION
This Preliminary Plan was formulated and prepared by
the Planning Commission of the City of Palm Desert with the
cooperation of the Palm Desert Redevelopment Agency (the
"Agency") in accordance with the Community Redevelopment Law,
California Health and Safety Code Section 33000, et seq. (the
"Community Redevelopment Law") and shall be the basis for the
Redevelopment Plan for Project Area No. 3 (the "Project Area").
More detailed plans, reports and studies will be prepared in
connection with the proceedings undertaken by the Agency to
prepare and consider a Redevelopment Plan for the Project Area.
II. DESCRIPTION OF THE BOUNDARIES OF THE PROJECT AREA
The boundaries of the proposed Project Area are set
forth on the diagram attached hereto as Exhibit "A" and
incorporated herein by reference.
III. GENERAL STATEMENT OF THE PROPOSED LAND USES
Redevelopment in the proposed Project Area will be in
conformity with the General Plan of the City of Palm Desert (the
"General Plan"), the Zoning Ordinance of the City and all other
applicable state and local building codes and guidelines.
IV. GENERAL STATEMENT OF THE PROPOSED LAYOUT OF PRINCIPAL
STREETS
The layout of principal streets proposed as the basis
for redevelopment of the Project Area are those in the Project
Area as shown on the diagram attached hereto as Exhibit "A" and
those shown in the Circulation Element of the General Plan.
Existing streets within the Project Area may be
closed, widened or otherwise modified, and additional streets
may be created as necessary for proper pedestrian and vehicular
circulation consistent with the General Plan.
V. GENERAL STATEMENT OF THE PROPOSED POPULATION DENSITIES
Consistent with the General Plan, low, medium and high
density residential uses will be the permitted range of dwelling
unit intensities. The population densities proposed as the basis
for the redevelopment of the Project Area are those which would
be consistent with the General Plan, but they may vary depending
upon the residential land use designation and the number of
dwelling units per acre that are actually developed.

VI. GENERAL STATEMENT OF THE PROPOSED BUILDING INTENSITIES
The building intensities proposed as the basis for
redevelopment of the Project Area are those that would be
consistent with the limits contained in the Zoning Ordinance and
General Plan. Anticipated limits would include: (1) the
percentage of ground area covered by buildings (land coverage);
(2) the ratio of total floor area for all stories of the
buildings to areas of the building sites (floor area ratio);
(3) the size and the location of the buildable areas on building
sites; and (4) the heights of buildings. The land coverage,
sizes and locations of buildable areas will be limited, as is
feasible and appropriate, to provide adequate open space and
parking.
VII. GENERAL STATEMENT OF THE PROPOSED BUILDING STANDARDS
The building standards proposed as the basis for
redevelopment of the Project Area will conform to the building
requirements of all applicable State statutes and all applicable
local codes and ordinances. The Agency may consider more
restrictive requirements and may incorporate such requirements
into the Redevelopment Plan, in the interest of the public
health, safety and welfare.

VIII. ATTAINMENT OF THE PURPOSES OF THE COMMUNITY
REDEVELOPMENT LAW
The proposed redevelopment of the Project Area would
attain the purposes of the Community Redevelopment Law.
The Project Area is characterized by conditions which
cause a reduction of, or lack of, proper utilization of the area
to such an extent that it constitutes a serious physical, social
or economic burden on the City of Palm Desert which cannot
reasonably be expected to be reversed or alleviated by private
enterprise acting alone. The physical environment is conducive
to social and health problems and there is physical deterioration
of structures and infrastructure, a lack of proper utilization of
the area, a decline in the economic viability of the area,
impaired investments and social and economic dislocation.
There are buildings and structures, used or intended to
be used for living, commercial, industrial, or other purposes,
which are unfit or unsafe to occupy for such purposes and are
conducive to ill health, juvenile delinquency and crime because
of defective design and character of physical construction,
faulty interior arrangement and exterior spacing, high density of
population and overcrowding, inadequate provision for
ventilation, light, sanitation, open spaces, and recreation

facilities, and age, obsolescence, deterioration, dilapidation,
mixed character, or shifting of uses.
There are parcels in the Project Area which suffer from
the subdividing and sale of lots of irregular form and shape and
inadequate size for proper usefulness and development and the
laying out of lots in disregard of the contours and other
topography or physical characteristics of the ground and
surrounding conditions. There are inadequate public improve-
ments, public facilities, open spaces and utilities serving the
Project Area and this situation cannot be remedied by private or
governmental action without the aid and assistance of the Agency.
There is a prevalence of depreciated values, impaired invest-
ments, and social and economic maladjustment in the Project
Area.
The foregoing described conditions have contributed to
the physical deterioration of structures and infrastructure, a
lack of proper utilization of the area and a decline in the
economic viability of the area.
The purposes of the Community Redevelopment Law are to
protect and promote the sound development and redevelopment of
blighted areas and the general welfare of the inhabitants of the
communities in which they exist. The purposes of the Community
Redevelopment Law would be attained by redevelopment of the

Project Area, including the planning, development, replanning,
redesign, clearance, reconstruction or rehabilitation, or any
combination of the foregoing, and the provision of such
residential, commercial, industrial, public or other structures
or spaces as may be appropriate or necessary in the interest of
the general welfare, including recreational and other facilities
incidental or appurtenant to them, by facilitating a higher and
better utilization of land and thereby contributing to the public
health, safety and welfare. Redevelopment of the Project Area
will also obtain the purposes of the Community Redevelopment Law
by stimulating construction activity and increasing employment
opportunities in
Project Area and
commercial and industrial areas of the proposed
in the City of Palm Desert and by providing
financial assistance in connection with the construction and
reconstruction of curbs, gutters, sidewalks, streets, and other
public facilities. Such purposes would also be attained by the
attraction of residential, commercial and industrial uses to
stagnant and unproductive areas, including the recycling of land
uses into viable productive uses consistent with the General Plan
of the City. It is further anticipated that the Agency will
provide financial assistance for the development of additional
residential, commercial and industrial construction and
rehabilitation in a manner which will make such development
economically feasible.

IX. CONFORMANCE TO THE GENERAL PLAN OF THE CITY
The proposed redevelopment described in this
Preliminary Plan conforms to the General Plan. The Preliminary
Plan proposes a plan for the redevelopment of the Project Area
which will be consistent with the General Plan and Zoning
Ordinance of the City.
X. GENERAL IMPACT OF THE PROPOSED REDEVELOPMENT PROJECT
UPON THE RESIDENTS AND THE SURROUNDING NEIGHBORHOOD
The impact of the project upon residents of the Project
Area and the surrounding neighborhood will be positive.
During redevelopment, impacts of the redevelopment
project upon residents of the proposed Project Area and
surrounding neighborhood will, in general, be minimal. Residents
within the Project Area may experience some temporary effects of
redevelopment due to the public works improvements which can
reasonably be expected to occur in the future. However,
redevelopment activities of the Agency will occur only when
sufficient financial resources are available and such actions
will produce effective redevelopment results. The proposed
redevelopment project, therefore, is intended to occur in phases
with only a limited amount of direct activity at any one time.

The long-term impacts upon Project Area residents and
the surrounding neighborhood will be positive due to the
elimination of conditions of blight. Redevelopment of the
Project Area will provide for the improvement, modernization,
planning, development, replanning, redesign, reconstruction and
rehabilitation of the Project Area and the provision of
residential, commercial, industrial, public and other structures
and open spaces in the interest of the general welfare. It is
anticipated that redevelopment activities by the Agency will
provide additional employment opportunities and enhance the
environmental quality of the Project Area and surrounding areas.
