HomeMy WebLinkAboutRes No 1387PLANNING 0144LSSION RFSOLUPIQ4PU. 1387 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND CONDITIONAL USE PERMIT FOR AN 11,255 SQUARE FOOT 164 CAPACITY CHILD CARE FACILITY. CASE NO. CUP 89-6 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 19th day of September, 1989, hold a duly noticed public hearing to consider the request of T.L.C. INC. for approval of a Negative Declaration of Environmental Impact and Conditional Use Permit for an 11,255 square foot 164 capacity child care facility on 1.19 acies within the R-2 S.O. zone located at the southwest corner of Portola Avenue and Santa Rosa Way; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify their actions: 1. The facility's 24 hour operation and generation of significant late night traffic is incompatible with a residential location. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That Conditional Use Permit 89-6 is hereby denied. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 3rd day of October, 1989, by the following vote, to wit: AYES: DOWNS, ERWOOD, JONATHAN, RICHARDS, AND WHITLOCK NOES: NONE ABSENT: NONE ABSTAIN: NONE :24, L.4-6 LLia/Cit.
