HomeMy WebLinkAboutRes No 1412PLANNING CCNMLSSION RESOLUTION NO. 1412 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL OF AN AMENDMENT TO THE ZONING ORDINANCE TEXT, SECTION 25.58.120. CASE NO. ZOA 89-2 WHEREAS, the City Council of the City of Palm Desert, California, did on the 16th day of January, 1990, hold a duly noticed public hearing to consider approval of an amendment to the zoning ordinance text, Section 25.58.120; and WHEREAS, said application has complied with requirements of the "City of Palm Desert Procedures to Ltilement the California Environmental Quality Act Resolution No. 80-89," in that the director of community development has determined the project is a class 8 categorical exemption; and WHEREAS, at said public hearing, upon hearing and considering all testimony arguments, if any, of all interested persons desiring to be heard, said planning commission mission did find the following facts and reasons to exist to reconmlend approval of a Zoning Ordinance Text Amendment: 1. That the Zoning Ordinance Amendment is consistent with the objectives of the zoning ordinance. 2. That the Zoning Ordinance Amendment is consistent with the adopted General Plan. 3. That the Zoning Ordinance Amendment would better serve the public health, safety, and general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the consideration of the council in this case. 2. That it does hereby approve a Zoning Ordinance Text Amendment, as provided in the attached exhibit, labeled Exhibit "A." DIAZ, Sec et PJ/db PLANNING COMMISSION RESOLUTION 1412 EXHIBIT "A" ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AMENDING SECTION 25.58.120 OF THE PALM DESERT MUNICIPAL CODE. WHEREAS, the City desires that all parking lots, public and private, have adequate shade to improve the comfort of residents and visitors; and WHEREAS, adequate shade will reduce energy consumption, improve the quality of the environment, and beautify commercial, civic and residential urban areas; and WHEREAS, the parking lot tree design will specify size, quantity and species. NOW, THEREFORE the City Council of the City of Palm Desert, DOES HEREBY ORDAIN as follows: SECTION 1: That Section 25.58.120 "Tree Requirements" of the zoning section of the Palm Desert Municipal Code be amended to read as follows: "25.58.120 Tree Requirements. The intent of this code shall be to improve and maximize the landscaping within the off-street open parking areas including but not limited to providing 501 or more of shade coverage In ten years, multi -trunk trees In windy areas, and north/south oriented parking areas to provide longer shade. The landscaping shall be provided to the extent of at least one twenty-four inch box tree, sized to nursery tree standards of average height, width and caliper for each species, per each three parking stalls or their equivalent. Acceptable parking lot trees adopted to the Coachella Valley environment shall be set by resolution of the City Council and shall continue in full force and effect until amended by resolution of the City Council." SECTION 2: That Section 25.58.121 "Hardscape Requirements" of the zoning section of the Palm Desert Municipal Code be added to read as follows: "25.58.121 Parking Lot Hardscape Requirements. Parking lot dividers, islands, planters and planting areas s ha l l be a minimum of four feet wide and four feet long. Trees are to be planted a minimum of four feet from walls, walks or buildings and to protect hardscape and encourage deep root development, root barriers shall be installed during planting operations." PLANNING COMMISSION RESOLUTION NO. 1412 w SECTION 3: That Section 25.58.122 "Parking Lot Tree Requirements" of the zoning section of the Palm Desert Municipal Code be added to read as follows: "25.58.122 Parking Lot Tree Irrigation Requirements. Irrigation •systems within parking lots shall be installed. The irrigation system shall be an automatic system with an irrigation timer and two drip or bubbler heads per tree to provide adequate deep root irrigation. Sprinkler heads are discouraged in planter islands and dividers to protect pavement." SECTION 4: That Section 25.58.123 "Parking Lot Tree Maintenance and Installation Requirements" of the zoning section of the Palm Desert Municipal Code be added to read as follows: "25.58.123 Parking Lot Tree Maintenance and Installation Requirements. All parking lot trees will be maintained by owner or their successors in perpetuity with owner required to perform all maintenance including but not limited to irrigation corrections fertilization, pruning and staking. All maintenance shall be performed with an overall goal of providing maximum shade with minimum damage to hardscape, vehicles and persons. All significantly injured, decayed or dead trees must be replaced within thirty days. Excavate all planting holes to two times the width of the plant container and to the depth of container. Backfill the planting hole to the depth of the planting container with native soil, compacted enough to prevent plant settlement. Plant may be backf i l l ed around the sides with native soil or with amended soil as recommended by landscape architect. Slow release type fertilizer tablets shall be placed around the plant at the rate recommended by the manufacturer. If soil does not readily drain (within about an hour) when the excavated hole is flooded with water, install a perforated pipe filled with crushed rock or gravel to aid in deep water penetration." PLANNING COMMISSION RESOLUTION NO. 1412 SECTION 5: The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once in the Palm Desert Post, a newspaper of general circulation printed, published and circulated in the City of Palm Desert and the same shall be in full force and effect thirty days (30) after its adoption."
