A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF PALM DESERT, CALIFORNIA, APPROVING A REQUEST FOR
A VARIANCE TO REDUCE THE REQUIRED LOT AREA FROM
13,000 SQUARE FEE! TO 10,890 SQUARE r'ir FOR THE
EXISTING R-1 13,000 ZONED 21,780 SQUARE FOOT LOT

NORTH OF ALESSANDRO.
CASE NO. VAR 89-8
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 16th day of January, 1990, hold a duly noticed public
hearing to consider the request of PERRY ASHBY for the above noted variance
request for property, more particularly described as:
A.P.N. 625-098-001
WHEREAS, said applicant has ccmplied with the requirements of the "City
of Palm Desert Procedure for Implement of the California Environmental
Quality Act, Resolution No. 80-89," in that the director of community
development has determined that the project is a Class 5 categorical
exemption for the purposes of CDQA; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said planning commission did find the following facts and reasons to
exist to justify approval of said variance:
1. That practical difficulties or unnecessary physical hardships
inconsistent with the objectives of this ordinance that would
result if the variance is not granted.
2. That exceptional or extraordinary circumstances or conditions that
apply to that property that do not apply generally to other
properties in the same zone was established to the satisfaction of
the commission.
3. That the strict or literal interpretation and enforcement of the
specified regulation will deprive the applicant of privileges
enjoyed by the owners of other properties in the same vicinity and
zone.
4. That the commission is satisfied that the granting of the variance
will not be detrimental to the public health, safety or welfare or
materially injurious to properties or improvements in the
vicinity.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Palm Desert, California as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case;

2. That approval of VAR 89-8 is hereby granted.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 16th day of January, 1990, by the
following vote, to wit:
AYES: JONATHAN, RICHARDS, AND WHITLOCK
NOES: NONE
ABSENT: DOWNS AND ERWOOD
ABSTAIN: NONE
