HomeMy WebLinkAboutRes No 1419PLANNING COMMISSION RESOLUTION AU. 1419 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW A DANCE SCHOOL TO OCCUPY 1000 SQUARE 1E;i' WITHIN A COMMERCIAL BUILDING AT 73-290 HIGHWAY 111. CASE NO. CUP 90-2 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 16th day of January, 1990, hold a duly noticed public hearing to consider the request of Edward M. Marrero for approval of a condition use permit to operate a dance studio in 100 square feet of canmercial space at 73-290 Highway 111; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project is a Class 2 categorical exemption for purposes of CEQA; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify the granting of said conditional use permit: 1. The proposed use is consistent with the intent and purpose of the Palm Desert Zoning Ordinance, Commercial Core Specific Plan and General Plan. 2. There exists adequate off-street parking to satisfy the needs of the proposed use without adversely effecting other tenants in the building. 3. The operation of the proposed dance studio will not adversely impact adjacent uses, depreciate property values in the vicinity or be injurious to the public health or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case; 2. That approval of Conditional Use Permit 90-2 is hereby granted for reasons subject to the attached conditions.
