HomeMy WebLinkAboutRes No 1442PLANNNING CCt4USSICN RESOLUTION ND. 1442 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING A REQUEST FOR A VARIANCE TO REDUCE THE REQUIRED LOT AREA FROM 14,000 SQUARE F'E:e1' TO 13,068 SQUARE 1u 1' FOR THE EXISTING R-1 14,000 ZONED 26,136 SQUARE FOOT LOT L0CATED AT THE SOUTHEAST CORNER OF SAN PASCUAL AND DE ANZA. CASE NO. VAR 90-1 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 1st day of May, 1990, hold a duly noticed public hearing to consider the request of Perry Ashby for the above noted variance request for property, more particularly described as: A.P.N. 627-171-001 WHEREAS, said applicant has complied with the requirements of the "City of Palm Desert Procedure for Implement of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project is a Class 5 categorical exemption for the purposes of CEQA; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify denial of said variance: 1. Commission could not positively affirm the four (4) required findings for approval of a variance specifically as follows: a. That exceptional or extraordinary circumstances or conditions that apply to this property that do not apply generally to other properties in the same zone was not established to the satisfaction of the commission. b. That the commission was not satisfied that the granting of the variance would rot be detrimental to the public health, safety, or welfare or be materially injurious to properties or improvements in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case; 2. That VAR 90-1 is hereby denied.
