A R'E`OLUT I ON OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, DENYING AN
AMENDMENT TO A CONDITIONAL USE PERMIT' ALLOWING AN
OFFICE BUILDING A DRIVEWAY ACCESS ON SANTA YNEZ
AVENUE.
CASE NO. CUP 89-12 Amendment #1
WHEREAS. the Planning Commission of the City of Palm Desert. California,
did on the 15th day of May, 1990, hold a duly noticed public hearing to
consider a request by CJH PARTNERS for approval of an amendment of a
conditional use permit to allow a driveway access on Santa Ynez: and
WHEREAS, at said public hearing, upon hearing and cons dlering ail
testimony and arguments. if any, of all interested persons desiring to be
heard, said planning commission did find the following facts and rrdt;uft-; to
exist to justify denial:
1. The proposed public access driveway represents an unacceptable
commercial intrusion in a residential area.
NOW. THEREFORE, BE IT RESOLVED by the Planning Commission of the City
Palm Desert. California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. That. Conditional Use Permit 89-12 Amendment ##1 permitting driveway
access to Santa Ynez is hereby denied.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 5th day of June, 1990, by the following vote.
to wit:
AYES: DOWNS, ERW00D, RICHARDS, AND WHITLOCK
NOES: JONATHAN
ABSENT: NONE
ABSTAIN: NONE
