HomeMy WebLinkAboutRes No 1459PLANNING C 4{ SSICN RESOLUrICN NO. 1459 A RESOLUTION OF THE PLANNING CCM+IISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECCNIMENDING TO THE CITY COUNCIL APPROVAL OF A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND PREZONING SECTION 11 T5S R6E TO PR-5 (PLANNED RESIDENTIAL FIVE DWELLING UNITS PER ACRE) AND P (PUBLIC) TO FACILITATE THE ANNEXATION OF THE PROPERTY TO THE CITY. CASE NO. C/Z 90-9 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 7th day of August, 1990, hold a duly noticed public hearing to consider the request of SUNRISE DESERT PARTNERS for approval of a Negative Declaration of Enviro-g ental Impact and prezoning Section 11, T5S R6E to PR-5 (planned residential five dwelling units per acre) and P (public) to facilitate the annexation of the property to the city; and WHEREAS, said application has canplied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of cinnunity development has determined that the project will not have an adverse impact on the envirrnment and a negative declaration has been prepared; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning ccimtission did find the following facts and reasons to exist to justify reccimmending approval of said prezcne and Negative Declaration of Envirnnnental Impact: 1. The proposed prezoni.ng to PR-5 and P is consistent with the North Sphere Specific Plan. 2. The proposed land use is consistent with the goals and objectives of the North Sphere Specific Plan and Palm Desert General Plan. 3. The proposed prezc ning will not depreciate property values, restrict the lawful use of adjacent properties or threaten the public health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the ccmmissicn in this case. PLANNING CaTIIISSICN RESOILUI'ION NO. 1459 2. That the Negative Declaration of Environmental Impact Exhibit "A" and C/Z 90-9 Exhibit "B" on file in the department of community development are hereby reoannended to the city council for approval. - PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Camtission, held on this 7th day of August, 1990, by the following vote, to wit: AYES: DOWNS, ERWOOD, RICHARDS, WHITLOCK NOES: NONE ABSENT: NONE ABSTAIN: JONATHAN ATTEST: A. The Director of the Department of Community Development, City of Palm Desert, California, has found that the described project will not have a significant effect an the environment. A copy of the Initial Study has been attached to document the reasons in support of this finding.
