A RESOLUTION OF THE PLANNING CCVNIISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, APPROVING AN
AMENDMENT TO A OONDITIONAL USE PERMIT TO ALLOW AN
845 SQUARE FOOT EXPANSION OF AN EXISTING
RESTAURANT THROUGH ENCLCGURE OF AN OUTDOOR PATIO
AT 73-520 EL PASDD.
CASE NO. CUP 13-80 Amendment #2
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 7th day of August, 1990, hold a duly noticed public hearing to
consider the request by DOMINICK MANCUSO'S TRATORIA for approval of an
amendment to a conditional use permit to allow an 845 square foot expansion of
an existing restaurant through enclosure of an outdoor patio at 73-520 El
Paseo; and
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedure for Implementation of the California Environmental
Quality Act, Resolution No. 80-89," in that the director of camunity
developnent has determined that the project is a c1a.G-s 3 categorical exemption
for purposes of CEQA; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said planning commission did find the following facts and reasons to
exist to justify the granting of said conditional use permit:
1. The proposed restaurant expansion is within the general parameters of
the original approval and will not adversely impact parking
availability for adjacent businesses.
2. The promotion and encouragement of successful restaurants on El Paseo
is consistent with the goals of the Commercial Core Area Specific
Plan and General Plan.
3. The proposed location of the conditional use and the calditicns under
which it will be operated and maintained will not be detrimental to
the public health, safety or general welfare, or be materially
injurious to properties or improvements in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the oammissicn in this case.
2. That Conditional Use Permit 13-80 Amendment #2 is hereby approved,
subject to the attached conditions.

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 7th day of August, 1990, by the following
vote, to wit:

Department of Ccr m unity Developnent.
1. Applicant shall comply with all state, county, and city regulations
concerning restaurant use.
2. The applicant shall obtain all necessary architectural review commission
and department of building and safety permits required by any physical
modification of the site.
3. Hours of operation shall be limited to after 5:00 p.m. until off -site
public parking is developed as part of the Ahmanson Project.
4. If lunch service is provided applicant shall require employees to use
offsite Ahmanson lot.
