A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF PALM DESERT, CALIFORNIA,
APPROVING A NEGATIVE DECLARATION OF
ENVIRONMENTAL IMPACT AND CONDITIONAL USE
PERMIT FOR A :36 STUDENT MONTESSOR I
PRESCHOOL AT 73- 92 5 FRED WAR I NG DRIVE.
CASE NO. C.LJF' 90--14
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 21st day of August, 1990, hold a duly noticed
public hearing to consider the request of L-AKSHMAN WICk::REMESINGHE for
approval of a negative declaration of environmental impact and
conditional Use permit for a 3'. student rnontessori preschool at. 73-925
Fred Waring Drive; and
WHEREAS, said application has complied with the requirements of the
"City of Palm Desert Procedure for Implementation of the California
Environmental Duality Act, Resolution No. )0- 9," in that the director
of community development has determined that the project will not have
an adverse impact on the environment and a negative declaration has been
prepared; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to
be heard, said planning commission did find the following facts and
reasons to exist to justify approval of said conditional use permit:
1. There is a service shortage of high quality child care
facilities in the Palm IDeser,(: area.
2. The proposed facility will provide necessary child care
services.
. As conditioned the site and proposed improvements are
appropriate for a child care facility.
4. As conditioned the use of the site for a child care facility
is compatible with adjacent residential and institutional
facilities.
NOW, THEREFORE, RE. IT RESOLVED by the Planning Commission of the
City of Palm I_Desert, California, as follows:
1. That the above recitations are true and correct and constitute
the findings of the commission in this case.
2. That a negative declaration of environmenta]. impact, Exhibit
"A", and Conditional Use Permit 90-14 on file in the
department of community development/planning is hereby
approved subject to conditions.

PASSED, APPROVED and ADOPTED at a regular meeting of the Palm
Desert Planning Commission, held on this 2151 day of Aygust, 1990, by
the following vote, to wit:

Department of Qmiunity Development/Planning:
1. The development of the property shall conform substantially with exhibits
on file with the department of community development, as modified by the
following conditions.
2. Prior to the issuance of a building permit for construction of any uses
contemplated by this approval, the applicant shall first complete all the
procedural requirements of the city which include, but are not limited to,
architectural commission and building permit procedures.
3. Operation of the proposed preschool shall commence within one year from
the date of final approval un1 -s a time extension is granted, otherwise
said approval shall become null, void and of no effect whatsoever.
4. The development of the property ciPscr-ibed herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
municipal ordinances and stated and federal statutes now in force, or
which hereafter may be in force.
5. Prior to issuance of a building permit for construction of any use
contemplated by the approval, the applicant shall first obtain permits
and/or clearance from the following agencies:
Palm Desert Architectural Commission
City Fire Marshal
Coachella Valley Water District
Palm Desert Water and Services District
6. That prior to issuance of building permit the owner (developer) provide
the city with evidence that he has paid the required school mitigation
fee.
7. Applicant shall obtain agreement from Valley Christian Assembly for long
term use of minimum 7 spaces in adjacent parking facility. If in the
future agreement is terminated and parking is no longer available,
conditional use permit is subject to revocation.
8. Capacity of the facility shall be limited to 36 children.
9. Hours of operation shall be limited to 6:00 a.m. to 6:00 p.m.

10. Outdoor activities shall be limited to 11:00 a.m. to 11:30 a.m. and 12:00
p.m. to 1:00 p.m.
11. Drive-thru shall be eliminated or repositioned so that no ingress or
egress exists on Fred Waring Drive.

PROJECT DESQRIPTIC;N/LOCATIC : A 36 student moritessori preschool at 73-925 Fred
Waring Drive.
The Director of the Department of Community Development, City of Palm Desert,
California, has found that the described project will not have a significant
effect on the environment. A copy of the Initial Study has been attached to
document the reasons in support of this finding. Mitigation measures, if any,
included in the project to avoid potentially significant effects, may also be
found attached.
