HomeMy WebLinkAboutRes No 1466PLANNING COMMISSION RESOLUTION NO. 1466 • A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT FOR A 960 SOUARE FOOT EXPANSION TO THE TUTTI GUSTI RESTAURANT LOCATED IN 1HE COLUMBIA CENTER AT THE SOUTH-WEST CORNER OF HIGHWAY 111 AND HIGHWAY 74. CASE NO. CUP 90-16 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 2lst day of August, 1990 hold a duly noticed public hearing to consider the request of JOSEPH BRANDT for approval of a conditional use permit for a 960 square foot expansion of the existing Tutti Gusti restaurant at 73-030 El Paseo; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Duality Act, Resolution No. 80-8:9, " in that the director of community development has determined that the project is a Class 1 categorical exemption for purposes of CEQA; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to a<:ist t.o justify the granting of said conditional use permit: 1. The proposed use is consistent with the intent and purpose of the Palm Desert Zoning Ordinance, Commercial Core Specific Plan and General Plan. 2. The operation of the proposed use will not adversely impact adjacent uses, depreciate property values in the vicinity or be injurious t.o the public health or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval. of Conditional Use Permit 90-16 is hereby granted for reasons subject to the attached conditions. PLANNING COMMISSION RESOLUTION NO. CUP 90-16 Department of Camunity Development: 1. The development of the property shall conform substantially with exhibits on file with the department of community development/planning, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statues now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year fran the date of final approval unless an extension of time is granted; otherwise said approval became null, void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Palm Desert Architectural Caimission City Fire Marshal Public Works Department Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. city Fire Marshal 1. Fire sprinklers may need to be relocated to provide adequate coverage when improvements are installed. 2. Comply with Title 19/24 of the California Administrative Code. 3. Install panic hardware and exit signs as per Chapter 33 of the Uniform Building Code. 4. Install portable fire extinguishers with a minimm rating of 2A-10BC. Contact a certified extinguisher company for proper placement of equipment. 3 PLANNING CONNIISSION RESOLUITCN NO. 1466 5. Please contact the Fire Department for a final inspection prior to occupancy. 6. Emergency lighting required, flame spread requirements shall be met as per UBC,CAC,NFPA. SS/db 4
