HomeMy WebLinkAboutRes No 1472PLANNING COMMISSION RESOLUTION NO. 1472 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO TF-IE CITY COUNCIL APPROVAL OF A NEGATIVE DECLARATION OF EENVIRONMEENTAL, IMPACT AND F'REZONING OF THE PROPERTY NORTH OF COUNTRY CLIJN DR.[VE, WEST OF WASHINGTON STREET, SOUTH OF THE RAILWAY RIGHT-OF-WAY TO THE EXISTING CITY LIMIT FOR THE: PURPOSE OF FACILITATINCG ANNEXATION C)F THE AREA TO THE CITY. CASE NO. C/Z 9 0-11 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 4th clay of September, 1990, hold a duly not iced public tearing to consider recommending to the city council approval of a negative declaration of environmental impact and pre::oning of the property north of Country Club Drive, west. of Washington Street., south of the railway right-of-way to the existing city limit for the purpose of facilitating annexation of the area to the city; and WHEREAS, said :application has complied with the requirements of the "City of F'alrn Desert Procedure for implementation of the California Environmental Quality Act, Resolution No. :O-29, " in that the director of community development has determined that the project will not have an adverse impact on the environment and a negative declaration has been prepared; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to he heard, said planning commission did find the following facts to justify their actions, as described below: 1. The proposed land uses are consistent with the goals and objectives of the North Sphere Specific: Flan and F'alrn Desert General Plan. 2. The proposed pre"zoning will not depreciate property values, restrict the lawful use of adjacent properties or threaten the public health, safety or general welfare. NOW. THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: t . That the above recitations are true and correct and constitute the findings of the commission in this case. That the Negative Declaration of Environmental Impact Exhibit "A" and C/Z 90-11 Exhibit "B" on file in the department of 1 PLANNING COMMISSION RESOLUTION NO. 147? community development are hereby recommended to the city council for approval. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 18th day of Segtember, 1990, by the following vote, to wit: AYES: DOWNS, ERWOOD, JONATHAN, AND WHITLOCK NOES: NONE ABSENT: NONE ABSTAIN: R[CHARDS SRS/tm CAROL WHITLOCK, Chairperson 2 PLANNING COMMISSION RESOLUTION NO. 1472 EXHIBIT "A" Pursuant. to Title 14, Division 6, Article California Administrative Code. NEGATIVE DECLARATION CASE NO: C/Z 90-- 1 1 Section of the APPLICANT/PROJECT SPONSOR: City of Palm Desert PROJECT DESCRIPTION/LOCATION: Prezoning of the property north of Country Club I_irive, west of Washington Street, south of the railway right-of-way to the existing city limit for the purpose of facilitating annexation of the area to the city. The Director of the Department of Community Development., City of Palm Desert, California, has found that the described project will not have a significant effect on the environment. A copy of the Initial Study has been attached to document the reasons in support of this finding.
