HomeMy WebLinkAboutRes No 1483PLANNING COMMISSION RESOLUTION NO. 1483 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING A CONDITIONAL USE PERMIT FOR A 600 SQUARE FOOT EXPANSION TO THE LOUISE'S PANTRY RESTAURANT LOCATED IN THE 111 TOWN CENTER AT THE NORTHWEST CORNER OF HIGHWAY 111 AND TOWN CENTER WAY. CASE NO. CUP 90-17 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 18th day of September, 1990, hold a duly noticed public hearing which was continued to December 4, 1990, to consider the request of SEAN SUNTAG for LOUISE'S PANTRY for approval of a conditional use permit for a 600 +/- square foot expansion of the existing Louise's Pantry restaurant at 44-491 Town Center Way; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project is a class 1 categorical exemption for the purposes of CEQA; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify denying said conditional use permit: 1. The setback for the proposed enclosed structure would not comply with the setback provisions in the PC (3) zone and implemented per the approved precise plan for the center. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That Conditional Use Permit 90-17 is hereby denied for the reasons cited above. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 4th day of December, 1990, by the following vote, to wit: AYES: NOES: ABSENT: ABSTAIN: ATTEST: k i, RAM N A.
