HomeMy WebLinkAboutRes No 1495PLANNING COMMISSION RESOLUTION NO. 1495 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A PRECISE PLAN AND SETBACK VARIANCE FOR A 3500 SQUARE FOOT ADDITION AND REMODEL OF AN EXISTING COMMERCIAL BUILDING AT THE SOUTHEAST CORNER OF EL PASEO AND SAGE LANE. CASE NOS. PP 90-24, VAR 91-1 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 19th day of February, 1991, hold a duly noticed public hearing to consider the request of JAMES WALLER for approval of a precise plan and setback variance for a 3500 square foot addition and remodel of an existing commercial building at the southeast corner of El Paseo and Sage Lane; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project is a class 3 categorical exemption for purposes of CEQA; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify granting approval of said precise plan and variance: 1. The proposed remodel and expansion implements policies of the Commercial Core Area Specific Plan regarding development of pedestrian retail on El Paseo. 2. With the exception of the approved variance, the precise plan complies with the standards of the C-1 zone. 3. The design of the proposed remodel will be compatible with adjacent commercial development and will not be detrimental to the public health, safety or general welfare. 4. The existing building design and grade differentials are unique circumstances inconsistent with the goals, objectives and policies of the Commercial Core Specific Plan and the El Paseo Pedestrian Overly Zone. 5. The literal interpretation of the setback standards would create unnecessary physical hardship making implementation of the Commercial Core Specific Plan recommendations economically infeasible. PLANNING COMMISSION RESOLUTION NO. 1495 6. The granting of the variance would allow the subject property comparable access and exposure afforded adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Precise Plan 90-24 and VAR 90-1 are hereby granted, subject to the attached conditions. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 19th day of February, 1991, by the following vote, to wit: AYES: ERWOOD, RICHARDS, AND WHITLOCK NOES: JONATHAN ABSENT: DOWNS ABSTAIN: NONE &i,i,t,e, i,t,/,tti&-e4) CAROL WHITLOCK, Chairperson PD/tm PLANNING COMMISSION RESOLUTION NO. 1495 CONDITIONS OF APPROVAL CASE NOS. PP 90-24, VAR 91-1 Department of Community Development: 1. The development of the property shall conform substantially with exhibits on file with the department of community development/planning, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the city which include, but are not limited to, architectural commission and building permit procedures. 3. Implementation of the precise plan shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval become null, void and of no effect whatsoever. 4. Prior to issuance of building permit for construction of any use contemplated by this approval, the applicant shall obtain permits or clearances from: City Fire Marshal Palm Desert Property Owners Association 5. Prior to issuance of building permits applicant shall execute reciprocal access easements with the owners of the Colonnade project to the east linking the two parking lots. Grading plan shall be designed to prevent any water from draining onto the Colonnade property. PD/tm
