HomeMy WebLinkAboutRes No 1501PLANNING COMMISSION RESOLUTION NO. 1501 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW A 4880 SQUARE FOOT RESTAURANT, 410 SQUARE FOOT OUTDOOR PATIO AND LIQUOR LICENSE AT THE NORTHWEST CORNER OF EL PASEO AND OCOTILLO DRIVE WITHIN THE EL PASEO COLLECTION NORTH RETAIL COMPLEX. CASE NO. CUP 91-4 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 19th day of February, 1991, hold a duly noticed public hearing to consider the request of CALIFORNIA PIZZA KITCHENS, INC., for approval of a conditional use permit to allow a 4880 square foot restaurant, 410 square foot outdoor patio and liquor license at the northwest corner of El Paseo and Ocotillo Drive within the El Paseo Collection North retail complex; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project is a class 3 categorical exemption for purposes of CEQA; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify granting approval of said conditional use permit: 1. The location of restaurants within retail commercial complexes are complimentary and beneficial to retail tenants in the vicinity. 2. The mix of uses in the El Paseo Collection complex and the available parking supplies are such that the proposed restaurant will not create a parking shortage in the area. 3. The proposed use is consistent with the goals and objectives of the General Commercial zone, Commercial Core Area Specific Plan and Palm Desert General Plan. 4. The proposed location of the conditional use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety or general welfare, or be materially injurious to properties or improvements in the vicinity. PLANNING COMMISSION RESOLUTION NO. 1501 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That Conditional Use Permit 91-4 is hereby approved, subject to the attached conditions. DIAZ, e 3 ary PD/tm CAROL WHITLOCK, Chairperson 2 PLANNING COMMISSION RESOLUTION NO. 1501 CONDITIONS OF APPROVAL CASE NO. CUP 91-4 Department of Community Development/Planning: 1. The development of the property shall conform substantially with exhibits on file with the department of community development, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the city which include, but are not limited to, architectural commission and building permit procedures. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless a time extension is granted, otherwise said approval shall become null, void and of no effect whatsoever. 4. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances as stated and federal statues now in force, or which hereafter may be in force. Prior to the issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District 6. Maximum restaurant size will be 4880 square feet indoors and 410 square feet outdoors. 7. Prior to occupancy by the restaurant applicant shall submit for approval and begin implementation of mandatory employee offsite parking program which diverts a minimum of 42 cars from the El Paseo Collection North lot to the El Paseo Collection South annex and the rear Galleria lots.
