A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND
APPROVING A TENTATIVE PARCEL MAP SUBDIVIDING INTO ELEVEN
PARCELS THE EXISTING 20 +/-ACRE LOT FOR A 194,000 SQUARE
FOOT RETAIL CENTER ON THE EAST SIDE OF HIGHWAY 111
BETWEEN FRED WARING DRIVE AND PARK VIEW DRIVE.
CASE NO. PM 27065
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 6th day of August, 1991, hold a duly noticed
public hearing to consider the request of WILLIAMSON AND SCHMID for the
above noted parcel map; and
WHEREAS, said application has complied with the requirements of the
"City of Palm Desert Procedure for Implementation of the California
Environmental Quality Act, Resolution No. 80-89," in that the director
of community development has determined that the project has been
previously assessed; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to
be heard, 'said planning commission did find the fqllowing facts and
reasons to exist to justify approval of the tentative; parcel map:
1. That the proposed map is consistent with applicable general
and specific plans.
2. That the design or improvement of the proposed subdivision is
consistent with applicable general and specific plans.
3. That the site is physically suitable for the type of
development.
4. That the site is physically suitable for the proposed density
of development.
5. That the design of the subdivision or the proposed
improvements are not likely to cause substantial environmental
damage or substantially and avoidably injure fish or wildlife
or their habitat.
6. That the design of the subdivision or the type of improvements
is not likely to cause serious public health problems.
7. That the design of the subdivision or the type of improvements
will not conflict with easements, acquired by the public at
large, for access through or use of property within the
proposed subdivision.
8. That the size of the lots created is sufficient so as to not
negatively impact any future passive or natural heating or
cooling opportunities.

NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute
the findings of the commission in this case. �•r
2. That it does hereby approve the above described Tentative
Parcel Map No. 27065, subject to the attached conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm
Desert Planning Commission, held on this 6th day of August, 1991, by the
following vote, to wit:

CONDITIONS OF APPROVAL
PM 27065
Department of Community Development/Planning:
1. The development of the property shall conform substantially with
exhibits on file with the department of community development, Case
No. PP 90-13, as modified by the following conditions.
2. Recordation of map shall occur within two years,from the date of
final approval unless an extension of time is granted; otherwise
said approval shall become null, void and of no.effect whatsoever.
3. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all municipal ordinances and state and federal statutes
now in force, or which hereafter may be in force.
4. Prior to issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain
permits and/or clearance from the following agencies:
Coachella Valley Water District
Palm Desert Architectural Commission
City Fire Marshal
Public Works Department
Evidence of said permit or clearance from the above agencies shall
be presented to the department of building and safety at the time
of issuance of a building permit for the use contemplated herewith.
5. That all conditions established pursuant to PP 90-13 and City
Council Resolution No. 91-5 shall apply to this tentative parcel
map 27065.
6. The eight foot high wall along the east property line identified
in City Council Resolution No. 91-5 shall be constructed prior to
the overall grading of the site; only that grading necessary for
the construction of that wall shall occur. Remaining portions of
the wall shall be constructed on a schedule approved by the
director of community development.
7. Applicant shall install approved wall and landscaping and hook up
to each individual property owners irrigation system and have that
six feet deeded over to the individual property owners through the

lot line process or grant an easement in perpetuity to all the
property owners use of that additional six feet. The choice of lot
line adjustment or deed shall be at the developers option.
8. That all gates and automatic gates referenced in previous approvals
shall be maintained by the developer.
9. All conditions of this parcel map shall be recorded with the
Riverside County Recorder for each parcel.
Department of Public Works:
1. All applicable provisions, conditions and requirements of Precise
Plan 90-13, Change of Zone 90-07 and General Plan Amendment 90-12
shall be considered as conditions of approval for this map.
2. Applicant shall offer for dedication on the parcel map all rights -
of -way and easements required under the above referenced project
numbers. The specific property configuration required for
dedication shall be based on final improvement design.
3. Easements as may be necessary for construction and maintenance of
a proposed storm drain system which runs through the property shall
be granted to the City of Palm Desert on the parcel map. The
specific alignment of the required easement shall be based on the
storm drain design as prepared by Engineering Service Corporation
and approved by the City of Palm Desert and shall be subject to
review by the applicant for project compatibility.
4. Construction of off -site improvements associated with this map
shall be in accordance with the requirements of Precise Plan 90-
13, Change of Zone 90-07 and General Plan Amendment 90-02.
