HomeMy WebLinkAboutRes No 1530PLANNING COMMISSION RESOLUTION NO. 1530 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA AMENDING THE CONDITIONS IMPOSED BY THE CITY COUNCIL WHEN IT APPROVED A 194,000 SQUARE FOOT RETAIL CENTER ON A 20 +/- ACRE SITE ON THE EAST SIDE OF HIGHWAY 111 BETWEEN FRED WARING DRIVE AND PARKVIEW DRIVE. CASE NO. PP 90-13 WHEREAS, the City Council of the City of Palm Desert, California, did on the 14th day of February, 1991, following a duly noticed public hearing, approved the request by DSL SERVICE COMPANY for the above mentioned project, subject to conditions; and WHEREAS, Mervyn's, the major tenant of the site has requested amendment to two of the conditions imposed in the City Council Resolution No. 91-5; and. WHEREAS, the.Plannj.ng Commission held a duly noticed public hearing this August 6, 1991 to consider the requested amendments; and WHEREAS, the project was previously assessed forcompliance with CEQA and a Negative Declaration of Environmental impact filed. NOW, THEREFORE, : BE.;IT RESOLVER by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the planning commission in this case. 2. That condition 13 of Resolution 91-5 be amended to read: "That deliveries be limited to the hours of- 6 4)0.-a. . to _ 10 :00 p. m. -._?.:_Ar y truck- _ engines/re-. rigeration units ',shall -be turned off whenever -said -vehicle will be parked for more -than -five minutes". 3. That condition 17 (1) of resolution 91-5 be amended to read: "That..overnight.parking of trucks or trailers with refrigeration units: shall not be allowed within 500 feet ''of residences or an alley PLANNING COMMISSION RFSOLUTION NO. 1530 PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 6th day of August, 1991, by the following vote, to wit: AYES: DOWNS, ERWOOD, JONATHAN, RICHARDS NOES: NONE ABSENT: WHITLOCK ABSTAIN: NONE ATTEST: RAMON A.
