HomeMy WebLinkAboutRes No 1554PLANNING COMMISSION RESOLUTION NO. 1554 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING AN AMENDMENT TO A CONDITIONAL USE PERMIT ALLOWING AN OFFICE BUILDING A DRIVEWAY ACCESS ON SANTA YNEZ AVENUE. CASE NO. CUP 91-11 Amendment #1 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 7th day of January, 1992, hold a duly noticed public hearing to consider the request of MAPLE LEAF PLUMBING, HEATING AND AIR CONDITIONING, INC., for approval of a conditional use permit to allow an office building driveway access on Santa Ynez Avenue; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify denial of the amendment: 1. The proposed location of the driveway would increase commercial traffic usage to the residential area, which would have a detrimental impact on adjacent residential properties. 2. Several local residents expressed concern with respect to the intrusion of commercial traffic into the residential area. 3. It was reported by one commissioner that eight trucks had been seen at the site, which was not an appropriate use for a building approved for office use only. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and the findings of the commission in this case. 2. That Conditional Use Permit 91-11 Amendment #1 driveway access to Santa Ynez is hereby denied. constitute permitting PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 21st day of January, 1992, by the following vote, to wit: AYES: NOES: ABSENT: ABSTAIN: JW/tm DOWNS, JONATHAN, RICHARDS, WHITLOCK SPIEGEL NONE NONE CAROL WHITLOCK, Chairperson
