HomeMy WebLinkAboutRes No 1572PLANNING COMMISSION RESOLUTION NO. 1572 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A PRECISE PLAN FOR A 23 UNIT SINGLE FAMILY RESIDENTIAL PROJECT ON 2.53 ACRES AT THE SOUTHWEST CORNER OF PORTOLA AVENUE AND SANTA ROSA WAY. CASE NO. PP 92-2 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 5th day of May, 1992, hold a duly noticed public hearing to consider the request of D & F DEVELOPMENT for approval of a precise plan for a 23 unit single family residential zero lot line project on 2.53 acres at the southwest corner of Portola Avenue and Santa Rosa Way; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project will not have an adverse impact on the environment and a negative declaration has been approved in connection with previously approved tentative tract map TT 25987; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify granting approval of said precise plan: 1. The proposed use and design of the project is consistent with the standards, goals and objectives of the R-2 single family residential zone, the Palma Village Specific Plan and the Palm Desert General Plan. 2. The site plan and architectural design of the project is of a high quality compatible with others existing and planned projects in the vicinity. 3. The project will therefore not depreciate values, restrict the lawful use of adjacent properties or threaten the public health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That Precise Plan 92-2 is approved, subject to attached conditions. DIAZ, rJary PD/tm CAROL WHITLOCK, Chairperson 2 PLANNING COMMISSION RESOLUTION NO. 1572 CONDITIONS OF APPROVAL CASE NO. PP 92-2 Department of Community Development: 1. The development of the property shall conform substantially with exhibits on file with the department of community development/planning, as modified by the following conditions. 2. Construction of portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance form the following agencies: Coachella Valley Water District Palm Desert Architectural Commission City Fire Marshal Palm Desert Water & Services District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Trash provisions including recycling shall be approved by applicable trash company and city prior to issuance of building permit. 6. Applicant shall pay school impact fees as arranged by the Desert Sands Unified School District. 7. Project shall be subject to Art in Public Places fee per Ordinance No. 473. 8. Applicant shall emphasize drought resistant and water conserving plant materials and irrigation technologies into 3 PLANNING COMMISSION RESOLUTION NO. 1572 landscape plan and shall comply with City of Palm Desert Maser Parking Lot Tree Plan. 9. Approval is subject to submission and approval of a tentative tract map. 10. Second story windows facing private yards will be a minimum sill height of 5'8". Department of Public Works: 1. Drainage fees, in accordance with Section 26.49 of the Palm Desert Municipal Code, shall be paid prior to the issuance of any permits associated with this project or recordation of the final map, whichever occurs first. 2. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17 and 79-55, shall be paid prior to the issuance of any permits associated with this project or recordation of the final map, whichever occurs first. 3. Transportation Uniform Mitigation Fees (TUMF) shall be paid prior to issuance of building permits. 4. Any storm drain construction shall be contingent upon a drainage study prepared by a registered civil engineer that is reviewed and approved by the Department of Public Works. 5. Full public improvements, as required by Sections 26.40 and 26.44 of the Palm Desert Municipal Code, shall be installed in accordance with applicable city standards. Subject improvements shall include, but not be limited to, minimum 36 foot wide interior roadway with concrete curb and gutter, city standard drive approaches, 6 foot wide sidewalk with handicap access on Santa Rosa Way and the proposed interior street and appropriate perimeter landscaping. 6. Complete improvement plans and specifications shall be submitted to the Director of Public Works for checking and approval before construction of any improvements is commenced. Offsite improvement plans shall be reviewed and approved by the Director of Public Works and a surety posted to guarantee the installation of all required offsite improvements prior to issuance of a grading permit or recordation of the final map, whichever occurs first. "As -built" plans shall be submitted to, and approved by, the Director of Public Works prior to the acceptance of the improvements by the City. 4 PLANNING COMMISSION RESOLUTION NO. 1572 7. All public improvements shall be inspected by the Public Works Department and a standard inspection fee paid prior to the issuance of a grading permit. 8. Landscaping maintenance on Portola Avenue and Santa Rosa Way shall be the responsibility of the property owner/homeowners association. In the event that no homeowners association is formed the applicant shall be responsible for the formation of a landscaping and lighting assessment district for the ongoing maintenance of the subject landscaping. 9. As required under Section 12.16 and 26.44 of the Palm Desert Municipal Code, all existing utilities shall be placed underground per each respective utility district's recommendation. If determined to be unfeasible, the applicant shall submit to the City, in a form acceptable to the City attorney, surety in an amount equal to the estimated construction costs for the subject undergrounding. 10. In accordance with Palm Desert Municipal Code Chapter 27, complete grading plans and specifications shall be submitted to the Director of Public Works for checking and approval prior to the issuance of any permits associated with this project. 11. Any and all offsite improvements shall be preceded by the approval of plans by the Director of Public Works and the issuance of valid encroachment permits by the Department of Public Works. 12. A complete preliminary soils investigation, conducted by a registered soils engineer, shall be submitted to and approved by the Department of Public Works prior to the issuance of the grading permit. 13. Landscaping, walls and other site improvements within a 40- foot "clear sight triangle" for all intersections shall be no higher than three feet above top of curb elevation. 14. Right-of-way at 50 feet (half street) on Portola Avenue shall be offered for dedication to the city of Palm Desert on the final map. 15. Complete tract map shall be submitted as required by ordinance to the Director of Public Works for checking and approval prior to the issuance of any permits. 5 PLANNING COMMISSION RESOLUTION NO. 1572 16. The existing open channel drainage facility located along the .r rear property line of the subject parcel shall be reconstructed as an underground pipe system. The design of this system shall be subject to the review and approval of the Director of Public Works. Drainage easements as may be necessary for this system shall be provided on the final map. 17. Proposed building pad elevations, shall be subject to review and modification in accordance with Section 27 of the Palm Desert Municipal Code. 18. Waiver of access to Portola Avenue and Santa Rosa Way except at approved locations shall be granted on the final map. PD/tm 6 mot
