HomeMy WebLinkAboutRes No 1589PLANNING COMMISSION RESOLUTION NO. 1589 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A NEGATIVE DECLARATION AND PREZONING PART OF SECTION 5, T5S R6E PR-7 (PLANNED RESIDENTIAL, 7 DWELLING UNITS PER ACRE) TO FACILITATE THE ANNEXATION OF THE PROPERTY TO THE CITY. CASE NO. C/Z 92-3 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 21st day of July, 1992, hold a duly noticed public hearing and continued public hearings on August 18 and October 20, 1992, to consider recommending to city council approval of a Negative Declaration of Environmental Impact and prezoning part of Section 5, T5S R6E PR-7 (Planned Residential, 7 dwelling units per acre) to facilitate the annexation of the property to the city; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project will not have an adverse impact on the environment and a negative declaration has been prepared; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts to justify recommending approval of said prezone and Negative Declaration of Environmental Impact: 1. The proposed prezoning of PR-7 is consistent with the existing land use. 2. The existing land use is consistent with the goals and objectives of the North Sphere Specific Plan and Palm Desert General Plan. 3. The proposed prezoning will not depreciate property values, restrict the lawful use of adjacent properties or threaten the public health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That the Negative Declaration of Environmental Impact Exhibit "A" and C/Z 92-3 Exhibit "B" on file in the department of community development are hereby recommended to the city council for approval. PLANNING COMMISSION RESOLUTION NO. 1589 PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this day of 20th day of October, 1992, by the following vote, to wit: AYES: DOWNS, JONATHAN, WHITLOCK, SPIEGEL NOES: NONE ABSENT: NONE ABSTAIN: WHITE SRS/tm ROBERT SPIEG 2 PLANNING COMMISSION RESOLUTION NO. 1589 EXHIBIT A Pursuant to Title 14, Division 6, Article 7, Section 15083, of the California Administrative Code. NEGATIVE DECLARATION CASE NO: C/Z 92-3 APPLICANT/PROJECT SPONSOR: City of Palm Desert PROJECT DESCRIPTION/LOCATION: Prezoning of part of Section 5, T5S R6E PR-7 to facilitate annexation of the area to the city. The Director of the Department of Community Development, City of Palm Desert, California, has found that the described project will not have a significant effect on the environment. A copy of the Initial Study has been attached to document the reasons in support of this finding.
