HomeMy WebLinkAboutRes No 1593PLANNING COMMISSION RESOLUTION NO. 1593 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING A REQUEST FOR A REAR YARD SETBACK ADJUSTMENT FROM 20 FEET TO 16 FEET FOR A ROOM ADDITION AT 74-370 COVERED WAGON TRAIL. CASE NO. ADJ 92-7 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 17th day of November, 1992, hold a duly noticed public hearing to consider the request of ZACHARY L. HENSLEY for the above mentioned project; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that since there will be no project no further environmental review is necessary; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify denial of the setback adjustment: 1. There were no unusual or extraordinary circumstances unique to this property that would not permit its use as a single family residential lot without the requested adjustment. 2. The setback adjustment would be detrimental to the adjacent residents from the closer proximity of noise impacts. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That ADJ 92-7 is hereby denied. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 17th day of November, 1992, by the following vote, to wit: AYES: NOES: ABSENT: ABSTAIN: ROBERT SPIEGEL',, ATTEST: RAMIN A.
