HomeMy WebLinkAboutRes No 1605PLANNING COMMISSION RESOLUTION NO. 1605 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING AN AMENDMENT TO A CONDITIONAL USE PERMIT TO ALLOW A 2,000 SQUARE FOOT MINI -MART AT 74-991 AVENUE 42 IN THE S.I. ZONE. CASE NO. CUP 92-3 A WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 2nd day of February, 1993, hold a duly noticed public hearing to consider the request of GEORGE BUONO for the above mentioned project; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project is a Class 3 categorical exemption for purposes of CEQA; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify the granting of said conditional use permit: 1. The proposed location of the conditional use is in accord with the objectives of the zoning ordinance and the purpose of the district in which the site is located. 2. The proposed location of the conditional use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety or general welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed conditional use will comply with each of the applicable provisions of this title, except for approved variances or adjustments. 4. The proposed conditional use complies with the goals, objectives, and policies of the city's adopted general plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Conditional Use Permit 92-3 A is hereby approved, subject to the attached conditions. DIAZ, Scary Palm Desert Planni Commission 2 ROBERT A. SPIEGE an PLANNING COMMISSION RESOLUTION NO. 1605 CONDITIONS OF APPROVAL CASE NO. CUP 92-3 A Department of Community Development: 1. Applicant shall comply with all city, state, and federal regulations. 2. The applicant shall obtain all necessary architectural review commission and department of building and safety permits required by any physical modification of the site. 3. Mini -mart shall be limited to 2000 square feet in area. 4. Off-street parking spaces (52) shall be striped according to submitted site plan prior to the opening of the mini -mart. 5. Hours of operation are limited to 5:00 a.m. to 10:00 p.m., seven days a week. Riverside County Sheriff's Department: 1. Fire sprinklers may need to be relocated or added to provide adequate coverage when improvements are installed. 2. Comply with Title 19/24 of the California Administrative Code. 3. Install common sense hardware and exit signs as per Chapter 33 of the Uniform Building Code. Door hardware per 3304(C) of the California Building Code. 4. Certain designated areas will be required to be maintained as fire lanes. Presently site access is in violation of the Uniform Fire Code, Sections 10.203 and 10.204. The original fire access on the west end of the buildings has been illegally obstructed by building materials and gates were previously installed without permits. 5. Install/modify the manual pull, smoke detection system as required by the Uniform Building Code and National Fire Protection Association to maintain proper coverage when improvements are installed. 6. Install portable fire extinguishers with a minimum rating of 2A- 10BC. Contact a certified extinguisher company for proper placement of equipment. 40BC extinguisher is required for commercial kitchens. 3 PLANNING COMMISSION RESOLUTION NO. 1605 7. Install a hood duct fire extinguishing system. Contact a certified fire protection company for proper placement. Plans must be approved by the fire department prior to installation. Applicant has not identified interior appliances. 8. Please contact the fire department for final inspection prior to occupancy. 9. Any changes to fire and life safety systems must be approved by way of plan submittal prior to work commencing. Alarm, sprinkler and fixed suppression systems must be submitted separately for approval. 10. A11 penetrations through rated fire walls and assemblies shall be properly sealed or dampered per Uniform Building Code Title 24. 11. Architectural plans must be submitted to City Building and Safety for approval. JW/tm 4
