A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, APPROVING A
PRECISE PLAN/CONDITIONAL USE PERMIT AND NEGATIVE
DECLARATION OF ENVIRONMENTAL IMPACT FOR A 2,000
SQUARE FOOT ADDITION TO AN EXISTING 24,000 SQUARE
FOOT RETAIL CENTER AND ASSOCIATED PARKING LOT
EXPANSION IN CONNECTION WITH A 6,120 SQUARE FOOT
RESTAURANT WITH LIQUOR LICENSE AND 1,000 SQUARE
FOOT OFFICE SPACE AT THE SOUTHWEST CORNER OF EL
PASEO AND OCOTILLO DRIVE, 73-061 EL PASEO.

WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 18th day of May, 1993, hold a duly noticed
public hearing to consider the request of EL PASEO COLLECTION for
approval of a precise plan/conditional use permit and Negative
Declaration of Environmental Impact for a 2,000 square foot addition to
an existing 24,000 square foot retail center and associated parking lot
expansion in connection with a 6,120 square foot restaurant with liquor
license and 1,000 square foot office space at the southwest corner of
El Paseo and Ocotillo Drive, 73-061 El Paseo; and
WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Procedure for Implementation of the California
Environmental Quality Act, Resolution No. 80-89," in that the director
of community development has determined that the project will not have
a significant impact on the environment and a Negative Declaration has
been prepared; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to
be heard, said planning commission did find the following facts and
reasons to exist to justify granting approval of said precise plan/
conditional use permit:
1. The location of a restaurant within retail commercial
buildings are complimentary and beneficial to retail tenants
in the vicinity.
2. The mix of retail and restaurant uses and the parking lot
expansion insure that the proposed restaurant will not create
a parking shortage in the area.
3. The design of the proposed parking lot meets the city's goals
concerning landscaping shading and screening as described in
section 25.38.110 of the Zoning Ordinance. Variance from the
six foot street property line setbacks prescribed in section
25.38.110 is justified by:
a. Adequacy of proposed parking lot screening by use of
property line walls and landscaping within the existing
parkway.

b. The city's desire to maximize parking resources within
the El Paseo area.
4. The proposed use is consistent with the goals and objectives
of the general commercial zone, Commercial Core Area Specific
Plan and the Palm Desert General Plan.
5. The proposed location of the conditional use and the
conditions under which it will be operated and maintained
will not be detrimental to the public health, safety or
general welfare, or be materially injurious to properties or
improvements in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the commission in this case.
2. That a Negative Declaration of Environmental Impact Exhibit
"A" and PP/CUP 93-4 are hereby approved, subject to the
attached conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm
Desert Planning Commission, held on this 18th day of May, 1993, by the
following vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. PP/CUP 93-4
Department of Community Development/Planning:
1. The development of the property shall conform substantially with
exhibits on file with the department of community development.
2. Applicant shall comply with all state, county, and city
regulations concerning restaurant use.
3. The applicant shall obtain all necessary architectural review
commission, department of building and safety, department of
public works, fire marshal, and health department permits required
by any physical modification of the site.
4. Restaurant shall be limited to 6,120 square feet in area.
5. Restaurant shall participate in a commercial recycling program as
approved by the Environmental Conservation Manager.
6. Approval includes variance from the six foot street property line
setback required by section 25.38.110 allowing parking spaces to
be developed up to the property line provided that appropriate
screening, including walls and landscaping, is included pursuant
to approval by the architectural commission.

PROJECT DESCRIPTION/LOCATION: A 2,000 square foot addition to an
existing 24,000 square foot retail center and associated parking lot
expansion in connection with liquor license and 1,000 square feet of
office at the southwest corner of El Paseo.
The Director of the Department of Community Development, City of Palm
Desert, California, has found that the described project will not have
a significant effect on the environment. A copy of the Initial Study
has been attached to document the reasons in support of this finding.
Mitigation measures, if any, included in the project to avoid
potentially significant effects, may also be found attached.
