HomeMy WebLinkAboutRes No 1622PLANNING COMMISSION RESOLUTION NO. 1622 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT FINDING THAT THE PROPOSED REDEVELOPMENT PLAN FOR PROJECT AREA NO. 4 OF THE PALM DESERT REDEVELOPMENT AGENCY CONFORMS TO THE GENERAL PLAN OF THE CITY OF PALM DESERT, AND RECOMMENDING APPROVAL OF THE PROPOSED REDEVELOPMENT PLAN THE PLANNING COMMISSION OF THE CITY OF PALM DESERT HEREBY FINDS, DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: Section 1. On February 2, 1993, the Planning Commission of the City of Palm Desert did select the boundaries of the proposed Project Area No. 4 of the Palm Desert Redevelopment Agency (the "Agency") and the Agency concurred with the selection of such boundaries. Section 2. The City of Paim Desert undertaking action to annex to the City the unincorporated County of Riverside territory located in proposed Project Area No. 4, and the General Plan of the City of Palm Desert sets forth observations, principles, standards and Plan proposals for the County territory. Section 3. The Agency did on April 22, 1993 approve the Draft Redevelopment Plan and authorize its transmittal to the Planning Commission. Section 4. Section 33346 of the Community Redevelopment Law, Health and Safety Code Section 33000 et seq., (the Redevelopment Law) proposes for the Planning Commission to review the proposed Redevelopment Plan for Project Area No. 4 and make its report and recommendation to the Agency and City Council including a determination that the proposed Redevelopment Plan is in conformance with the City of Paim Desert's General Plan. Section 5. The Planning Commission hereby finds and determines that the Redevelopment Plan for Project Area No. 4 is in conformity with the General Plan of the City of Palm Desert. Section 6. The Planning Commission hereby finds and determines that the location, purpose, and. extent of (i) real property to be acquired by dedication or otherwise for street, park, public space, or other public purpose; (ii) real property to be disposed of; (iii) streets to be vacated or abandoned; and (iv) public buildings or structures to be constructed or authorized, all pursuant to or in furtherance of the Redevelopment Plan, conforms to the General Plan of the City of Palm Desert. PLANNING COMMISSION RESOLUTION NO. 1622 Section 7. The Planning Commission hereby authorizes and directs the officers, employees, staff, consultants, and attorneys for the Planning Commission to take any and all actions that may be necessary to effectuate the purposes of this Resolution, or are appropriate or desirable in the circumstances, including but not limited to the preparation of documents, and the filing and transmittal of documents and information. In the event that prior to its adoption of the Redevelopment Plan, the Agency or City Council desire to make any minor, technical, or clarifying changes to the Redevelopment Plan, the Planning Commission hereby finds and determines that any such minor, technical, or clarifying changes need not be referred to it for further report and recommendation. Section 8. The Planning Commission hereby recommends the approval of the Redevelopment Plan for Project Area No. 4 by the Agency and by the City Council of the City of Palm Desert. Section 9. This resolution shall constitute the report and recommendation of the Planning Commission to the Redevelopment Agency pursuant to Section 33346 of the Redevelopment Law. Section 10. The secretary of the Planning Commission is hereby authorized and directed to transmit a copy of this resolution to the Agency.
