HomeMy WebLinkAboutRes No 1632PLANNING COMMISSION RESOLUTION NO. 1632 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT AND NEGATIVE DECLARATION TO ALLOW A 5780 SQUARE FOOT BILLIARD FACILITY WITH ON -SITE BEER AND WINE AT 73-608 HIGHWAY 111. CASE NO. CUP 93-9 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 7th day of December, 1993, hold a duly noticed public hearing to consider the request of CIRKO INC. dba ST. GEORGE PLACE for approval of a conditional use permit and negative declaration to allow a 5780 square foot billiards facility with on -site beer and wine at 73-608 Highway 111; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project is a Class 3 categorical exemption for purposes of CEQA; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify the granting of said conditional use permit: 1. The proposed billiard facility will occupy a presently vacant large commercial building and bring additional customers into the commercial area. 2. The proposed location of the conditional use permit and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety or general welfare, or be materially injurious to properties or improvements in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Conditional Use Permit 93-9 is hereby granted subject to the attached conditions. PLANNING COMMISSION RESOLUTION NO. 1632 PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 7th day of December, 1993, by the following vote, to wit: AYES: NOES: ABSENT: ABSTAIN: BEATY, JONATHAN, WHITLOCK, SPIEGEL NONE NONE NONE 2 PLANNING COMMISSION RESOLUTION NO. 1632 CONDITIONS OF APPROVAL CASE NO. CUP 93-9 Department of Community Development/Planning: 1. That the hours of operation be limited to 12:00 noon to 2:00 a.m. seven days a week. Said hours to be approved for a maximum six month period with review at that time if sufficient complaints are received. 2. That in order to maintain the primary use of the facility as a billiard facility, bar seating shall be limited to 20 seats and one table with a maximum four seats per billiard table. 3. Applicant shall comply with all state, federal and city regulations. 4. That the operator shall be required to monitor the parking lot in an effort to prevent loitering and creating problems for surrounding businesses. 5. During business hours at least one of the north access doors shall be available for patron ingress/egress to or from the north onsite parking lot. NEGATIVE DECLARATION CASE NO: CUP 93-9 APPLICANT/PROJECT SPONSOR: CIRKO INC. dba St. George Place 73-608 Highway 111 Palm Desert, CA 92260 PROJECT DESCRIPTION/LOCATION: A 5780 square foot billiard parlor and entertainment center licensed for the sale of beer and wine at 73-608 Highway 111. The Director of the Department of Community Development, City of Palm Desert, California, has found that the described project will not have a significant effect on the environment. A copy of the Initial Study has been attached to document the reasons in support of this finding.
