HomeMy WebLinkAboutRes No 1642PLANNING COMMISSION RESOLUTION NO. 1642 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL THAT ORDINANCE 623 BE RESCINDED AND ASSOCIATED SENIOR HOUSING DEVELOPMENT AGREEMENT TERMINATED. Case No. CUP 90-18 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 19th day of April, 1994, hold a duly noticed public hearing to consider a request by John and Nancy Weber, owners of the subject property for termination of the Senior Housing Agreement; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify recommendation to terminate the development agreement: 1. The applicant/property owner no longer intends to proceed with the project as described in the development agreement and has received approval from the city for a precise plan (PP 91-11) for which a development agreement is not required. 2. The continued existence of Ordinance 623 is inconsistent with PP 91-11 and prevents its implementation. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That the Planning Commission recommends that the City Council rescind Ordinance 623 terminating the Senior Housing Development Agreement between the City and John and Nancy Weber. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 19th day of April, 1994, by the following vote, to wit: AYES: JONATHAN, WHITLOCK, SPIEGEL NOES: NONE ABSENT: BEATY ABSTAIN: NONE ROBERT A.
