HomeMy WebLinkAboutRes No 1649PLANNING COMMISSION RESOLUTION NO. 1649 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING AN AMENDMENT TO A CONDITIONAL USE PERMIT TO ALLOW THE EXPANSION OF THE MAIN ASSEMBLY AREA OF THE VALLEY CHRISTIAN ASSEMBLY FROM 2782 SQUARE FEET TO 3971 SQUARE FEET AND EXPANSION OF THE PARKING LOT FROM 59 SPACES TO 116 SPACES ON PROPERTY LOCATED WEST OF PORTOLA AVENUE BETWEEN FRED WARING DRIVE AND SANTA ROSA WAY. CASE NO. CUP 84-9 AMENDMENT WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 21st day of June, 1994, hold a duly noticed public hearing to consider the request by VALLEY CHRISTIAN ASSEMBLY for approval of an amendment to the conditional use permit allowing expansion of the main assembly area and parking lot on the property described above; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project is a Class 1 categorical exemption for the purposes of CEQA; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify the granting of said conditional use permit: 1. That the expanded use of the property as a church is compatible with the surrounding uses and will not be detrimental to the public health, safety or welfare. 2. The proposed church use is consistent with goals and objectives of the Palm Desert General Plan, Zoning Ordinance and COD Specific Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That Conditional Use Permit 84-9 Amendment is hereby approved subject to the attached conditions. CUP 84-9 AMENDMENT Department of Community Development: 1. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the city which include, but are not limited to, architectural review commission approval of the landscaping and walls and building permits. 2. The development of the property shall conform with all approved exhibits on file with the department of community development, to all municipal, state, and federal statutes now in force and which hereafter may be in force. 3. That construction of the expanded parking lot shall be completed and approved by the city prior to issuance of an occupancy permit for the expanded assembly area. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Review Commission City Fire Marshal Coachella Valley Water District Palm Desert Water and Services District 5. Location and design of trash enclosures if relocated shall be coordinated with Palm Desert Disposal Company. 6. Prior to the issuance of any building or grading permits, applicant shall submit and gain approval of a parcel map or parcel map waiver consolidating all parcels involved in the proposed expansion. 7. That the fencing material adjacent to Portola Avenue shall be tan slump stone to match that along Santa Rosa Way. 8. That the access driveways to Santa Rosa Way and Portola Avenue shall be closed to vehicular traffic except for specific large functions of the church (i.e. regular Sunday Worship and other events attended by large numbers of parishioners). 3 PLANNING COMMISSION RESOLUTION NO. 1649 Department of Public Works: 1. Drainage fees, in accordance with Section 26.49 of the Palm Dot ..� Municipal Code, shall be paid prior to issuance of a grading permit. 2. Full public improvements, as required by Section 26.44 and 26.40 of the Palm Desert Municipal Code, shall be installed in accordance with applicable City standards. Subject improvements shall include, but not be limited to, the installation of minimum 24 foot wide drive approaches and installation of a minimum six foot wide sidewalk on Santa Rosa Way. Vehicular use of the Santa Rosa access points shall be restricted to Sundays. Offsite improvement plans shall be reviewed and approved by the Director of Public Works and a surety posted to guarantee the installation of all required offsite improvements prior to issuance of a grading permit. "As -built" plans shall be submitted to, and approved by, the Director of Public Works prior to the acceptance of the improvements by the City. 4. All private driveways and parking lots shall be inspected by the engineering department and a standard inspection fee paid prior to the issuance of a grading permit. 5. Landscaping maintenance on all property frontages shall be the responsibility of the property owner. Nor 6. In accordance with Palm Desert Municipal Code Chapter 27, complete grading plans and specifications shall be submitted t o the Director of Public Works for checking and approval prior to the issuance of any permits associated with this project. 7. Any and all offsite improvements shall be preceded by the approval of plans by the Director of Public Works and the issuance of valid encroachment permits by the Department of Public Works. 4 Nod
