HomeMy WebLinkAboutRes No 1651PLANNING COMMISSION RESOLUTION NO. 1651 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW ESTABLISHMENT OF A 1480 SQUARE FOOT RESTAURANT IN SUITE G OF THE CENTER AT 73-850/910 HIGHWAY 111. CASE NO. CUP 94-6 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 21st day of June, 1994, hold a duly noticed public hearing to consider the request by GERARDO VALENCIA, for approval of a conditional use permit allowing a 1480 square foot restaurant licensed for serving of alcoholic beverages by ABC on the property described above; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project is a Class 3 categorical exemption for the purposes of CEQA; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify the granting of said conditional use permit: 1. That a restaurant is a permitted use in the C-1 zone and a parking survey concludes that adequate parking is available to support the proposed use if it is located to the east end of the center at 73-910 Highway 111. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That Conditional Use Permit 94-6 is hereby approved subject to the attached conditions. RAMON A. DIAZ, -cry Palm Desert Planni Commission PLANNING COMMISSION RESOLUTION NO. 1651 CONDITIONS OF APPROVAL CASE NO. CUP 94-6 Department of Community Development: 1. The development of the property shall conform with all approved exhibits on file with the department of community development, to all municipal, state, and federal statutes now in force and which hereafter may be in force. 2. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Review Commission City Fire Marshal Coachella Valley Water District Palm Desert Water and Services District 3. Prior to the issuance of any building or grading permits, the property owner shall submit and gain approval of a parcel map or parcel map waiver consolidating the parcels involved in the two centers. 4. That the restaurant hours shall be 7:00 a.m. until 10:00 p.m. daily. 5. That the restaurant operator shall contract with Palm Desert Disposal for adequate pick up service in order that food odors do not become a problem. 6. Licensing by Alcohol Beverage Control shall be limited to beer and wine only. 2
